AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 4 OF THE OFFICIAL
CODE OF ASPEN, AND PROVIDING FOR THE ADOPTION, WITH MINOR
VARIATIONS, OF THE UNIFORM BUILDING CODE, 1964, EDITION, OF
THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 50 South
Los Robles, Pasadena, California, 91101, and DECLARING AN
EMERGENCY TO EXIST~
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1: Section 1 of Chapter 1 of Title 4
of the Official Code of Aspen, Colorado, is hereby amended
to read as follows:
4-1-1: Adoption of Code: The Uniform Building
Code, 1964 Edition, of the International Conference
of Building Officials, 50 South Los Robles, Pasadena,
California, 91101, including all appendices except
as hereinafter stated, is hereby adopted as The
Buildng Code of and for the City of Aspen, Colorado,
for regulating the erection, construction, enlargement,
alteration, repair, moving, removal, demolition,
conversion, occupancy, equipment, use, heighth,
area and maintenance of all buildings or structures
in the City of Aspen, Colorado, providing for the
issuance of permits and the collection of fees
therefor, and the fixing of penalties for violations
thereof. Three certified copies of said Code are
on file in the office of the City Clerk, and may be
inspected during regular business hours.
Section 2: Section 2 of Chapter 1 of Title 4 of
the Official Code of the City of Aspen, Colorado, is hereby
amended to ~ad as follows:
4-1-2: Exceptions: Whenever the provisions of the
Uniform Building Code shall conflict with the
provisions of the National Electric Code, the Warm
Air Heating, Ventilating and Air Conditioning Code,
the Gas Fitting Code, the Chimney, Vents, Fireplaces
and Incinerator Code, and the Boiler and Pressure
Vessels Code, adopted by this Code, the provisions
of the Uniform Building Code shall supercede the
provisions of such other adopted Codes. Chapters
13, 23, and 48 of the Section referred to as an
appendix of the Uniform Building Code are hereby
expressly excepted from adoption and deleted from
said Code.
Section 3: Subsection (2) of Section 3 of Chapter 1
of Title 4 of the Official Code of the City of Aspen is hereby
repealed in its entirety.
Section 4: The City Council of the City of Aspen,
in adopting this ordinance, hereby finds that an emergency
exists, and that this ordinance is necessary for the iw~ediate
preservation of the public peace, health and safety, and
the same shall be in full force and effect five (5) days
after its final passage and publication.
