HomeMy WebLinkAboutordinance.council.009-66RECORD OF PROCEEDINGS 100 Leaves ORDIMANC.,E NO. ~ (s~ries of 196'6]-- AN ORDINANCE At~ID~ TITIZ III, CF~tF~R 3, OF T~ ORDINANCES OF TH~ ~ OF ,15P~, ~- IT ORD~ by the City Council of the City of Aspen, Colorado: Section i: Section 3-3-6 of Chapter 3 of Title III, of the Official Code of the City of Aspen, Colorado, is hereby re-enacted in its entirety to provide as follows: ~3-3-6: RATES AND /2iAi: (a) For .the purpqses of this (~rdinance, rates end charges for_the use of water for "Residential Purpose" shall apply only to water service delivered t~rou~h tap connections t~bree-fourths (3/4%hs) of an inch or smaller for usual and ordinary residential purpose. ~ubjact to water services tap limitation, such residence rates shall prevail notwithstandin§ the fact that the consumer in such residence conducts therein a business or businesses not requiring water for other than usual residential F~rposes. Subject to water service tap limitation, such residence rates shall likewise prevail if not more than two (2) rooms are available in such residence for rental purposes. Should the Manager determine that the flat rate for residential purposes hereinahove prescrihed wouldhe greater than the minimum rate herein prescribed for the period indicated, the fiat ~te hereinbefore prescribed shall apply for the period of use. The rates herein prescribed shall not apply unless the consumer has requested of the Manager a disconnect of service for the period of non-use. If the service is metered, the rates prescribed for metered residential purposes shall apply. The season for irrigation water tx~rposes shall he deemed June, July and August, annually, and the ~snager shall add to the bills rendered to all oons~ers ~o which this rate or c~ar§e is applicable, one-thix~l (1/3rd) of the season charge on each of the bills rendered July 1, August 1, and September 1, annually. (c) All charges and assess~ants for the use of water shall be billed by the Manager ~et~an the first and the fifth of each calendar month of use. Such bills a~e p~yable upon hein9 mailed to the consumer at his add~ess on file with the Manager. A penalty equal to ten percent (10%) of such bill shall be added to any such bill not paid on or before the fifteenth (15th) da~ of the calendar month the same becomes due. The Manager shall disconnect ~he water service to any consumer who fails to pa~ such bill on or before the twentieth (20th) day of the calendar month ~he same becomes due. Cd) A service charge of t~o dollars ($2.00) is he~.by established for each connect and each disconnect of -~ator servive howsoever occurring. (e) I~unicipal, quasi-municipal or 9overnmantal agencies, supported in whole or in part Dy general @~ope~y taxes shall be deemed within the CAty for the purposes of their rate schedules irrespective of the fact that the service connection or use m~y be without the City. (f) Except as set forth tns~section (e) hereof, the point of place of use of water shall he determinative on whether the Within City or the Without City ra~e or charge is applicable. If any use of water through a tap or connection is made outside of the City Limits of the City of ~.~pen, all use through such tap or connection shall he deemed ~ithout City for rate or char§e pttrpO ses· (MOTEs Amended by Ordinance No. 5, Series 1963; Section 3, Ordinance No. 21, Series 1964.) Section 2: Section 3-3-7 of Chapter 3 of Title III, of the Official Code of the City of Aspen, Colorado, is hereby re-enacted in its entirety to read as follows: -?- "3-3-7: METER RE(N3LATIC~S: (a) All premises using water from the water mains of the City of Aspen, Colorado, for any purpose, ~hether residential or commercial, shall have the option of taking and measuring water through a meter and ~ying for the ssme according to meter mea- surements thereof at the rates established by this Ordinance or shall take water and pay for same at the re~ulsr rates and charges as estab- lished elsewhere by this Ordinance. (Amended t~y Section h, Ordinance No. 21, Series 196h; Section 1, Ordinance No. lb, Series 1965.) (b) In no case shall the o~ner of any premises be allowed to take part of the water used on said premises on a flat rate basis, snd part on the meter basis, but ineevery case, such owner shall take and pay for all the water used by him, on any one premises, either on the flat rate or on the meter rate basis. Section ~.: Because of the matters and things hereinabowe set forth, the City Council of the City of Aspen, Colorado, hereby finds, determines and declares that an emergency exists, and that this ordinance is necessary for the immediate preservation of public peace, health and safety.
