HomeMy WebLinkAboutordinance.council.003-64ORDINANCE NO. ~ Series of 1964 AN ORDINANCE AMENDING CHAPTER 2 OF TITLE VII1 AND SPECIFICALLY SECTIONS 8-2-1 and 8-2-2, OF THE OFFICIAL CODE OF ASPEN, COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1: That Chapter 2 of Title VII1 and being specifically Sections 8-2-1 and 8-2-2, of the Official Code of Aspen, Colorado, are hereby amended in their entirety, so as to read as follows: 8-2-1: PERMIT; FEE: It shall be unlawful for any person to cut, excavate, dig or otherwise interfere with the surface of any street, alley, sidewalk area or other public way, in the City of Aspen, Colorado, without first obtaining a permit for such work from the Building Inspector of the City of Aspen, Colorado. The fee for each such permit issued by the Building Inspector for such excavations shall be One Dollar ($1.00) per square foot of surface area of the proposed cut and excavation, plus the cost of repair thereof to be com- puted by the Building Inspector at the time the permit is issued. 8-2-2: METHOD OF MAKING CUTS AND EXCAVATIONS; AND RESTORATION OF THE S~_N[E: Any cut in any pavement or surfacing shall be made in a neat manner with square edges and corners. Such cut shall be made with a pavement breaker or saw. All ma- terial taken from the cut and the excavation shall be trucked away and disposed of by the holder of the permit at the time the cut and excavation is made. The Department of Public Works of the City of Aspen, Colorado, shall fill the excavation and repair the cut upon completion of the purpose for which the same was made, or as soon thereafter as is reasonably possible. Such department shall fill and compact the excavation with gravel or other suitable material to within six (6) inches of the surround- ing surface in the case of pavement or surfacing, and complete the repair with concrete to conform to the surface of the surrounding area. Where the cut and excavation is in an un- surfaced area, the compacted fill shall be made to a point uniform with the surrounding area. Section 2: Sections 8-2-3 and 8-2-4 shall be and remain a part of the code unamended by the foregoing. Section 3: The City Council of the City of Aspen, Colorado, hereby finds, determines and declares that an emer- gency exists, and that this ordinance is necessary for the immediate preservation of public peace, health and safety.
