HomeMy WebLinkAboutordinance.council.005-64ORDINANCE NO. ~ Series of 1964 AN ORDINANCE PROVIDING FOR THE VACCINATION AND LICENSING OF DOGS; FOR THE IMPOUNDING AND DISPOSITION OF UNLICENSED DOGS; FOR THE ~EP~AL OF PRIOR ORDINANCES ON TI~ SAME SUBJECT MATTER; AND DECLAR- ING AN EMERGENCY TO EXIST. Colorado: BE IT ORDAINED by the City Council of the City of Aspen, Section 1: That Ordinance No. 1, Series of 1962, and Sections 6-3-1 through 6-3-20, both inclusive, of Chapter 3, Title VI, of the Official Code of Aspen, Colorado, and all other ordinances relating to the subject of dogs in the City of Aspen, Colorado, are hereby repealed. Section 2: This ordinance shall be known as the "Dog Control Ordinance of the City of Aspen, Colorado", and in this ordinance the following definitions shall control: "Dog' shall mean any animal of the canine species, regard- less of sex. "Vaccination" shall mean vaccination or innoculation of a dog with a vaccine approved by the Colorado State Department of Health for use in prevention of rabies. "Owner" shall mean the person, or persons, firm, entity, association, or corporation that owns, keeps or harbors a dog. Section 3: No dog over the age of six months shall be kept or maintained within the City of Aspen, Colorado, or being kept or maintained without the City of Aspen, Colorado, be allowed to enter the City of Aspen, Colorado, unless or until the omer of such dog shall obtain a license for such dog as hereinafter provided. This requirement of licensing shall not apply to: (a) A dog owned by a blind person and kept and maintained by such person as a 'seeing-eye' dog. (b) A dog owned by a person who is a non-resident of the City of Aspen, Colorado, and who is not employed in Pitkin County, Colorado. (c) A dog brought into the City of Aspen, Colorado, for the purpose of participating in a dog show, or exhibition, and which is removed from the City at the conclusion of such dog show or exhibition. Section 4= Ail license fees established by this ordinance shall be for the calendar year of issue and the whole fee shall be imposed irrespective of the date application is made for a license. Any dog in the City of Aspen, Colorado, on or after April 1, 1964, and any dog in the City of Aspen on or after March 1, annually, there- after, and required to be licensed hereunder, shall be licensed as follows= (a) The owner thereof shall make application for such license to the City Clerk of the City of Aspen, Colorado, on forms furnished by such Clerk. (b) The Clerk shall, on such application, obtain sufficient information concerning such dog to identify it and its ownership, including the age, breed, color and sex, and if a female, whether or not spayed, of such dog, and the name and address of the owner. (c) At the time of making application the owner shall furnish to and leave with the Clerk a certificate of a licensed practitioner of veterinary medicine showing that such dog has -2- received vaccination no earlier than November 1 of the calendar year preceeding the application. No dog shall be licensed unless such certificate of vaccination is so furnished. (d) The said City Clerk shall collect in advance of licensing, a license fee of $3.50 for each male dog licensed, a license fee of $3.50 for each spayed female dog licensed, and a license fee of $?.50 for each female dog licensed. (e) The said City Clerk shall furnish a numbered license tag and a receipt for the license fee to the owner for each licensed dog. The owner of such licensed dog shall attach such license tag to the collar or harness of such licensed dog. Duplicate tags shall be issued by said City Clerk upon application for a fee of twenty-five (25~) cents. (f) The said City Clerk shall index and keep on file for at least two (2) years all such applications, vaccination certificates and other evidences of licensing. Section 5= The City Administrator is hereby authorized to provide, by contract or otherwise, facilities suitable for the keep- ing of dogs, which facilities shall be known as the #pound'. Ail dogs placed in the pound shall be deemed 'impounded'. Section 6. It shall be the duty of every police officer, and of any person employed for the purpose of apprehending and impounding dogs, to apprehend and impound any~licensed dog found in the City of Aspen, Colorado, which does not have a current n~m~ered license tag issued by the City Clerk under this Ordinance attached to a collar or harness on such dog. Section ?= It shall be the duty of every police officer, -3- and of any person emplo1~d for the purpose of apprehending and impounding dogs, to apprehend and impound any dog of a fierce, dangerous or vicious propensity, any dog that is infected or diseased, or any female dog in heat, whether or not such dog is currently licensed. Section 8= Not later than forty-eight (48) hours after the /mpounding of any dog, the owner thereof, if known, shall be notified. If the owner of the dog cannot be ascertained within such period, a notice shall be published in the next issue of a newspaper of general circulation within the City of Aspen, Colorado, which notice shall describe such dog and ~s place of confinement. Any dog not claimed within five (5) days after notice to the owner, or within five (5) days after the date of publication of such notice, may be sold by the City Administrator to defray the cost of impounding, notice and care, or, if not so sold, may be destroyed. Section 9: A charge of $3.00 is hereby made for the impounding of any dog. An additional charge of $3.00 per day is hereby made for each day, or part thereof, the dog is kept in the pound, including the day of removal, but not including the day of impounding. No dog shall be released from the pound until the owner shall have paid all charges for impounding the dog, the additional charges for maintaining the dog, the cost, if any, for publishing the notice of impounding, and until the dog has been licensed as in this ordinance required. Section 10: No dog of fierce, dangerous or vicious propensities shall be released from the pound, unless and until the City Administrator is satisfied that suitable provisions have been made by the owner to protect the public against such -4- propensities. No dog that is diseased or infected shall be released, unless or until the City Administrator is satisfied that suitable arrangements have been made by the own e r to forestall the continuation or spread of such infection o~ disease. If the same such dog is twice impounded in any one calendar year, as being either fierce, dangerous or vicious, or infected or diseased, such dog shall be destroyed on the second impounding after five (5) days notice to the owner, if known, of intention to do so. Section 11. In the event that any dog of fiercer dangerous or vicious propensities is found and its apprehension and impoundment cannot be safely accomplished, the person attempting apprehension and impoundment may forthwith destroy such dog. Section 12. The City Council of the City of Aspen~ Colorado, hereby finds, determines and declares that an emergency exists, and that this ordinance is necessary for the immediate preservation of public peace, health and safety.
