Colorado. BH IT ORDAINED by the City Council of the City of Aspen, Section 1~ Ail ashes, trash and garbage hauled or con- veyed within the City limits of the City of Aspen, Colorado, or through the City of Aspen, Colorado, shall be hauled in a closed container, or containers, or, if being hauled or conveyed in a vehicle, shall be so covered or closed',~so that the contents can- not fall or be blown from such vehicle. Section 2: No person hauling or conveying ashes, trash or garbage within the City limits of the City of Aspen, Colorado, or through the City of Aspen, Colorado, shall allow any ashes, trash or garbage to fall or be blown from the container or vehicle used for such hauling or conveying. Section 3: Any person guilty of a violation of this ordinance, or any provision thereof, upon conviction, shall be punished by a fine not exceeding Three Hundred Dollars ($300.00) or by imprisonment not exceeding Ninety (90) days, or by both such fine and imprisonment. Section 4: In view of the fact that various persons hauling ashes, trash and garbage, or one or more of them, to the City dump, are allowing the same to fall or be blown from the vehicle conveying the same, thereby littering the streets and alleys of the City of Aspen, Colorado, an emergency is declared to exist, and this ordinance is declared to be necessary for the immediate preservation of the public peace, health and safety of the citi- zens of the City of Aspen, Colorado. Section 5: This ordinance shall be in full force and effect Five (5) days after its proper passage and publication.
