AN ORDINANCE PROVIDING FOR THE LICENSING OF BICYCLES IN THE CITY OF ASPEN, COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO.
SECTION 1. License required - No person, who resides within the
City of Aspen, shall ride or propel a bicycle on any street, or upon any
public path set aside for the exclusive use of bicycles, unless such
bicycle has been licensed and a license plate attached thereto as hereinafter
provided.
SECTION 2. License Application - The application for every bicycle
license shall be made upon a form provided by this City, which shall be
obtained from the office of the Chief of Police. A license application fee
of one dollar ($1.00) shall be paid to the City before each license application
is processed and the license granted. No renewal of license shall be necessary
unless said license shall have been revoked or suspended pursuant to the
provisions of the Offical Code of Aspen.
SECTION 3. Issuance of License
(a) The Chief of Police upon receiving proper application and
payment of the license application fee shall proceed to physically examine
the bicycle to be licensed to determine that said bicycle is equipped in the
manner required by the Official Code of Aspen and that such equipment is in
good working order.
(b) The Chief of Pol$ce may require the license applicant to take
an examination, oral or written, to determine the applicant's knowledge of
the traffic regulations of the City of Aspen applicable to bicycle operation.
(c) The Chief of Police, in his sole discretion, shall determine
if a bicycle license shall be issued to the license applicant based upon the
requirements of sub-paragraphs (b) and (c) of this Section 3.
(d) Bicycle licenses shall become effective upon issuance.
(e) The Chief of Police shall keep a record of the number of each
license, the date issued, the name and address of the person to whom issued, the
number of the frame of the bicycle for which issued, and a record of all bicycle'
license application fees collected by him.
(f) License application fees collected by the Chief of Police shall
be remitted to the City Treasurer monthly who shall give a receipt therefor.
SECTION 4. Attachment of License Plate
(a) The Chief of Police upon issuing a bicycle license shall also
issue a license plate bearing the number assigned to the bicycle and the name
"Aspen" thereon.
(b) The Chief of Police shall require such license plate to be
immediately and firmly attached to the rear fender or frame of the bicycle
for which issued in such a position as to be plainly visible from the rear.
(c) No person shall remove a license plate from a bicycle except
upon a transfer of ownership or in event the bicycle is no longer operated
upon any street in this Cityi
SECTION 5. Transfer of Ownership - Upon the sale or other transfer of
ownership of a licensed bicycle, the licensee shall remove the license plate.
The license plate shall then be surrendered to the Chief of Police or may,
upon proper application, have said plate assigned to another bicycle owned by
the licensee. Such a transfer application by the licensee shall be accompanied
by a fee of fifty cents (50¢).
SECTION 6. Rental A~encies - A rental agency shall not rent or
offer any bicycle for rent unless the bicycle is first licensed and a license
plate is attached thereto as required by this ordinance.
SECTION 7. An emergency is declared to exist and the immediate
passage of this Ordinance is necessary for the public peace, health and
safety of the inhabitants of the City of Aspen, Colorado, and this Ordinance
shall be in full force and effect five days after its final publication
