AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A TRACT OF LAND KNOWN AS RIVERSIDE
ANNEX TO Tn CITY OF ASPEN, COLORADO, TO BE MADE A PART OF THE CITY OF ASPEN;
DESCRIBING SAID LAND BY METES AND BOUNDS; DESIGNATING SAID LAND AS A PART OF
WARD NO. 1; AND DECLARING AN EMERGENCY TO EXIST.
WI{EREAS, petition was filed with the City Clerk for the City of Aspen
on August 20, 1962, requesting the annexation of a tract of land known as the
RIVERSIDE ANNEXTO THE CITY oF ASPEN, COLORADO, together with copies of a map
of such territory, which petition was signed by owners of more than fifty per
cent of the area and who also comprised a majority of the landowners residing in
the territory at the time the petition was filed, all pursuant to Section 139-11-3
of Colorado Revised Statues, 1953,
WHEREAS, the City Council for the City of Aspen did by Resolution
accept said ~1~ for annexation of said land at a regular council meeting
on September 4, 1962,
WHEREAS, notice of said petition was duly published in the Aspen Times,
a newspaper of general circulation on November ~, 1962, November 9, 1962 and
November 16, 1962, and no counter-petitions have been filed within 30 days of
the4~me~_[~ublication of said notice,
WHEREAS, all requirements of Chapter 139, Article~ Colorado
Revised Statutes, 1953, have been complied with in connection with the annexation
of said territory,
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNOlL OF THE CITY OF ASPEN:
SECTION 1: That the following described tract of land situate in the
County of Pitkin, State of Colorado, known as ~e Riverside Annex to the City of
Aspen, Colorado, adjoining or touching the boundary line of the City of Aspen and
so situated that not less than one sixth of the aggregate external boundaries of
said tract of land coincide with existing boundaries of the City of Aspen, is
hereby added to, annexed, taken into and made a part of the City of Aspen:
A tract of land situate in the Riverside Placer Mining Claim, U.S.M.S
3905 A.M., the Mascotte Lode Mining Claim, U.S.M.S. 5867, the Lone Pine Mining
Claim, U.S.M.S. 1910, the Molly Gibson Lode Mining Claim, U.S.M.S. 4281, and
the Jennie V Lode Mining Claim, U.S.M.S. 5310, Roaring Pork Mining District, in
Pitkin County, State of Colorado~ Beginning at Corner No. 1, which is coincident
with E.A.T. 12, thence N. 45°00' E. 2~.97 feet to Corner No. ~which is coincident
with E.A.T. 11; thence N. 0°14' E. 467.9 feet to Corner No. 3, which is coincident
with E.A.T. 10; thence N. 42°40' E. 221.2 feet to Corner No. 4; thence N. 38000' E.
100.0 feet to Corner No. 5; thence S 43°40' E. 291.99 feet to Corner No. 6; thence
N 38°00' E. 194.3 feet to C(r ncr No. 7; thence N. 45o21' E. 136.5 feet along the
co~on boundry between U.S.M.S. 1910, Lone Pine Mining Claim, and U.S.M.S. 5867,
Mascotte Mining Claim to Corner No. 8; thence S. ??°35' E. 374.8 feet to Corner No. 9;
thence S. 45o09' W. 347.58 feet along the c~on houndry between the said Mascotte
Mining Claim and U.S.M.S. 6899, The "99" Lode Mining Claim, to Corner No. 10, which is
coincident with Corner No. 2 of the Mascotte Lode Mining Claim and Corner No. 2 of The
"99" Lode Mining Claim; thence N. 89°46' W. 89.15 feet to Corner No. 11, which is the
Easterly boundry of the public road right-of-way (D. & R. G. W. Railroad right-of-way);
thence follow the Easterly boundry of the public road right-of-way Southerly to the
Northern boundary of the Colorado State Highway No. 82 to Corner No. 12; thence
N. 54030' W. 113.5 feet to Corner No. 13, which is coincident with the Southeast corner
of Lot 18 of Block 6, Riverside Addition; thence N. 75006' W. 590.0 feet along the
No£therly boundary of State Highway No. 82 to Corner No. 14; thence N. 45°00' W. 60.0
feet to Corner No. 1, the place of beginnin§.
SECTION 2. That the land described in S~:tion 1 of this Ordinance is
hereby assigned to and made a part of Ward No. 1 of th~ City of Aspen.
SECTION 3: That the map of said tract of land described in Section t
hereof shall be filed in the office of the Clerk and Recorder for Pttkin County
on the effective date of this Ordinance; and that a copy of the map and a
certified copy of the petition for annexation and a certified copy of this
Ordinance shall be filed with the Secretary of State of the State of Colorado.
SECTION 4: An emergency is declared to exist and the immediate passage
of this Ordinance is necessary for the public peace, health and safety of the
inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full.
force and effect five (5) days after its final publication.
INTRODUCED, READ AND ORDERED publ ished as provided by law
by the City Council of Asp~, Colorado~ at its regular meeting held at the

the aforegoing Ordinance was introduced and read at a regular
meeting of the City Council of said City of Aspen on the

passage in the Aspen Times, legal newspaper; and that on
