AN ORDINANCE AMEN~/NG TITLE IX, cHAPTER 3, SECTION 5, OF THE OFFICIAL CODE
OF ASPEN, PROVIDING A DEDUCTION OF FIVE (5%) PER CENT OF THE TOTAL TAX
COLLECTED UNDER SAID ORDINANCE RECEIVED BY THE OPERATOR OF A ROOMING
HOUSE FOR THE PURPOSE OF DEFRAYING EXPENSE IN CONNECTION WITH COLLECTION
OF SAID TAX.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO:
SElf,ON 1. That Title IX, Chapter 3, Section 5 of the Official
Code of Aspen is hereby amended to read as follows:
9-3-5: DEDUCTIONS:
The following deductions shall be allowed against
total rental revenue received by the operator of a rooming house:
(a) Refunds of rental revenues actually returned
to any roomer or customer.
(b) Any adjustments in rental which amount to a
refund to a roomer or a customer, providing such adjustment
pertains to the actual rental rate charged by the operator and
does not include any adjustments for other services furnished by
the operator.
(c) The sum of five (57°) per cent of the total
amount of the tax collected under this Ordinance may be retained
by the operator of a rooming house for the purpose of defraying
expense incurred by the operator by reason of the collection of
said tax.
SECTION 2. An emergency is declared to exist and the immediate passage
of this Ordinance is necessary for the public peace, health and safety of the
inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full
force and effect five (5) days after its final publicat~on.
