HomeMy WebLinkAboutordinance.council.003-63ORDINANCE NO. ~ (Series of 1963) AN ORDINANCE PROVIDING FOR THE ERECTION OF TEMPORARY OUTDOOR SIGNS, PRESCRIBING THEIR LOCATION, CONSTRUCTION ANDAREA LIMITATION; PRO- VIDING FOR THE ISSUANCE AND DURATION OF PERMITS; PROVIDING FOR THE REMOVAL OF CERTAIN SIGNS; PROVIDING PENALTIES FOR THE ENFORCEMENT THEREOF AND DECLARING AN EMERGENCY TO EXIST. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: SECTION 1: Temporary Outdoor Signs are defined as any sign, streamer, pennant, valance or display construction of cloth, canvas, light fabric~ cardboard, wallboard, or other light materials with or without frames, intended to be displayed for a short period of time only, advertising special events of a cu.~unity interest. SECTION 2: For all Temporar~ Outdoor Signs erected, a permit shall be required. Such permits shall authorize the erection of said signs and the maintenance thereof for a period of not mor~ than six (6) days prior to the event advertised; nor more than twenty-four (24) hours after the termination of said event. No permit for temporary outdoor signs shall exceed a period of fifteen (15) days. SECTION 3: The message, lettering or wording on any Temporary outdoor Sign shall pertain only to special events of community interest being conducted within the co~unity. Temporary Outdoor Signs shall make no reference to sales, auctions or product advertising bi general and co~ercial business. SECTION 4: Temporary outdoor Signs shall not exceed fifty (50) Equate feet in area. SECTION 5: Every Temporary Outdoor Sign weighing in excess of twenty (20) pounds must be approved by the Building Inspector and shall conkorm to' the safety requirements of the Building Code of the City of Aspen. SECTION 6: No Temporary Outdoor Sign shall be erected or located in such a manner as to impair the safety of a moving vehicle by distracting or obstructing the vision of the driver of the vehicle. The color, design or location of Temporary Outdoor Signs shall not cause confusion or interfere with traffic~signs or signals. SECTION 7: No Temporary Outdoor Sign shall be erected, so as to prevent free ingress to or egress from any door, window or fire escape; nor shall such sign be attached to or obstruct any standpipe, fire hydrant or fire escape. SECTION 8: Any sign n~v or hereafter existing which no longer identifies a bona fide business conducted, product sold or special event, is hereby declared a nuisance end shall be taken down By the owner, agent or person having the beneficial use of said si~n, within ten (10) days after ~rritten notification from the Building Inspector, and upon failure to comply with such notice within the time specified in such order, the Building Inspector is hereby authorized to cause removal of such si~n, and any expense incident thereto shall be paid hy the owner of the property on which said si~n was located. EXCEPTION: Signs of historical character shall not be subject to the provisions of this section. For the pur- pose of this section historical signs are defined to be those signs erected prtor to Jenuary 1, 1945. SECTION 9: Signs used for the purpose of advertising the sale of real property shall not be subject to the provisions of Sections 2 and 3 of this Ordinence; provided however, that said signs shall be limited to four (4) square feet in area and shall not be placed in or project into eny public right of way. SECTION 10: Should any section, clause, or provision of this Ordinance be declared by court of competent Jurisdiction to be invalid, such decision shall not affect the validity of this Ordinance as a whole or any pa~t thereof other then the part declared invalid. SECTION 11: Any person found ~uilty of violating this ordinance shall be fined not less than $5.00 nor more than $300.00. SECTION 12: An emergency is declared to exist and the ~mmediate passage of this Ordinance is necessary for the public peace, health end safety of the inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full force end effect five (5) days after its final publication.
