HomeMy WebLinkAboutordinance.council.005-63ORDINANCE NO. 5 (Series of 1963) ORDINANCE AMENDING SECTION 3.~3~5 AND SECTION 3-3-6 OF THE OFFICIAL CODE OF ASPEN, ESTABLISHING A CHANGE IN WATER BATES WITHIN THE CITY OF ASPEN, AND OUTSIDE OF THE CITY OF ASPEN; PROVIDING FOR SHUTOFF OF WATER U~ON FAILURE TO PAY THE CHARGES THEREOF; AND DECLARING AN EMERGENCY TO EXIST. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: SECTION ~: Subsection (a) of Section 3-3-5 of the Official Code of Aspen is hereby amended to read as follows: "SHUT-OFFS: (a) If after a permit to the use of water shall have been issued, it shall be ascertained that water is being used on any premises not authorized by said permit or by any permit or in a greater amount or for a different pur- pose than that provided for in said permit or permits, or if any water user shall fail or refuse to pay the water charges for the use of water, as the same shall become due, it shall be the duty of the Manager to shut off said water, providing, however, the Manager shall give the owner of such premises 48 hours notice prior to the date said water is to be shut off." SECTION 2: Section 3-3-6 of the Official Code of Aspen is hereby amended to read as follows: "3-3-6 RATES AND CHARGES: There shall be charges and assessments to all consumers of the Aspen Water-Works for the use of water, mede by the Manager in accordance with the following schedule of rates: (a) DOMESTIC WATER--RESIDENCE USE (1) APPLICABILITY. Applicable within the territory served in and near City of Aspen, Colorado. (2) AVAILABILITY. These rates are available to all residential users of water, including residences where no more than 2 rooms are available for rent, except for muni- cipal hydrants, large users, or where use requires the installation of a meter. The chmrge indicated covers the first outlet or fixture in each unit. Additional fixtures are to be charged at the specified rate therefor. (3) TYPE OF USE. Ten (10) per cent will be added to all bills under this schedule if not paid within twelve (12) days after same are due. A service charge of $2.00 shall be made for establishing each water connection. Also a disconnect cbmrge of $2.00 shall be made for disconnection of service for non-payment of bill or for any violation of any rule or regulation. (b) DOMESTIC WATER - COMMERCIAL USE (1) APPLICABILITY. Applicable within the territory served in and near City of Aspen, Colorado. (2) AVAILABILITY. These rates are available to all commercial users of water, including residences where mo~e than 2 rooms are available for rent, except for municipal hydrants, large users, or where use requires the installation of a meter. The charge indicated covers the first outlet or fixture in each unit. Additional fixtures are to be charged at the specified rate thereof. (3) RATES. This flat rate is available to customers who desire water service for vacant lots only. Where service is connected and for the purpose of sprinkling and/or irrigation of lawns and gardens. (3) RATE. Hose tap 3/4" or sraaller, (any tap to which hose can be attached): Within City Without City $2.95 $5.7o (4) MINIMUM CHARGE. Net minimum charge not less~han three month billing for each tap connected. (5) DELAYED PAYMENT PENALTY. Bills payable monthly in advance. Ten (10%) per cent will be added to all bills under this schedule if not paid within twelve (12) days after same are due. A service charge of $2.00 shall be made for establishing each water connection. Also a disconnect charge of $2.00 shall be made for disconnection of service for non-payment of bill or for any violation of any rule or regulation. (f) Df~ESTIC WATER - RESIDENTIAL AND COMMERCIAL USE - IRRIGATION the water users and gardens. (1) APPLICABILITY. Applicable within defined water territory at Aspen, Colorado. (2) AVAILABILITY. Available to all for the purpose of sprinkling and/or irrigation of lawns (3) ATE. Twenty cents (20¢) per front foot per season for lot units of 125 feet or less in depth. Example: Property 30' x 175' 2 times 30' equals 60' times 20¢ equals $12.00 Property 60' x 350' 3 times 60' equals 180' times 20¢ equals $36.00 These charges are to be added to all customers bills for water use under Residential, Commercial and vacant lot schedules, where custo- mers use water regularly to sprinkle or irrigate according to company use checks. Charges for this use will be added to bills for July, August and September each year - 1/3 each month. (4) DELAYED PAYMENT PENALTY. Ten percent (10%) will be added to all bills under this schedule if not paid within twelve (12) days after same are due. SECTION 3: Ail sections of the Aspen Code in conflict herewith shall be and are hereby repealed. SECTION 4: An emergency is declared to exist and the im- mediate passage of this Ordinance is necessary for the public peace, health and safety of the inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full force and effect five (5) days after the final publication.
