HomeMy WebLinkAboutordinance.council.007-61ORDINANCE NO. 7 (Series of 1961) AN ORDINANCE PROVIDING FOR A LICENSE FOR THE ENGAGING IN ANY VOCATION, OCCUPATION OR BUSINESS IN THE CITY OF ASPEN; PRO- VIDING FOR EXEMPTIONS FROM SUCH LICENSE; PROVIDING PENALTIES FOR VIOLATIONS THEREOF AND DECLARING AN MMERGENCY TO EXIST. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: SECTION 1: The engaging in any vocation, occupation or business within the City of ~pen is hereby declared to be a privilege and the license fee on such privilege shall be the sum of $25.00 annually, which license fee shall be paid to the City Clerk for the City of Aspen on or before February 1 of each and every year, providing that license fees for the balance of the calendar year 1961 shall become payable irmmediately upon the effective date of this ordinance. The license required by this section on each occupation, vocation or business is for the privilege of pursuing said occupation, vocation or business until the next succeeding December 31, tne end o~ tme calendar year. Any person, firm or corporation licensed under other ordinances of the City o~ Aspen shall be credited for the amount of any such fees paid thereunder against the fee provided in Section 1 hereof, and if such fee does not exceed $25.00, such person shall pay to the City Clerk the difference between the fee paid under such other ordinances and $25.00. If the license fee paid under such other ordinances shall equal or exceed $25.00, then no license fee shall be charged by the Clerk under this ordinance. SECTION 2: A. Each person, firm, or corporation, which is engaged in any vocation, occupation or business within the City of Aspen shall be liable for the payment of the license fee pro- vided in Section 1 above. B. Any person acting as agent, trustee, guardian, ad- ministrator, executor, assignee or receiver, doing any of the acts herein declared to be a privilege is subject to the fee imposed on that privilege. C. Every person conducting a business in more than one established place of business shall not be liable for a license for business done at each separate location. D. A partnership, corporation or company sha~l be entitled to operate said business under a single license and the person or persons having an interest in said business shall not be separately subject to said license fee by reason of such interest. SECTION 3: The following acts of doing business are hereby exempted from this ordinance: A. Newsboys selling magazines or newspapers on the public street or in public places. B. Persons working for hire not engaged in their own independent business. SECTION 4: Any license issued under this ordinance shall not be transferrable except that the persons named in Section 2B shall not be required to pay a license fee for the remaining portion of the calendar year during which such person's office may have become effective. SECTION 5: It shall be unlawful for any person, partnership, company or corporation to engage in any vocation, occupation or business in the City of Aspen, unless excepted under Section 3 hereof, without first having procured a license therefor and having'paid the licensing fee as provided in this ordinance and any and all persons, partnerships, companies, or corporations conducting any such vocation, occupation or business in violation of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than $5.00 nor more than $300.00 for each day such privilege is exercised w~thout a license. SECTION 6: If any court of competent jurisdiction should ever determine that any part of this ordinance is invalid or unen- forceable, such determination shall not affect the remaining parts hereof, the intention being to make the provisions herein severable. SECTION 7: An emergency is declared to exist and the immediate passage of this ordinance is necessary for the public peace, helth and safety of the inhabitants of the City of Aspen, Colorado, and this ordinance shall be in full force and effect five (5) days after its final publication.
