AN ORDINANCE VACATING THE ALLEY IN BLOCK 102 AND A PORTION OF UTE
AVENUE, THE ORIGINAL CITY AND TOWNSITE OF ASPEN, AND RESERVING
EASEMENTS FOR UNDERGROUND AND OVERHEAD UTILITIES.
WHEREAS, the Aspen Skiing Corporation is the owner of
all of the lots in Block 102, City and Townsite of Aspen,
WHEREAS, the Aspen Skiing Corporation has agreed to
convey to the City of Aspen for public right-of-way purposes the
following described land situate in said Block 102:
A strip of land forty (40) feet wide extending from
the South line of Durant Street southerly to the point of
intersection with Ute Avenue, (being a portion of Lots H,
I, R and S, Block 102, City and Townsite of Aspen, Colorado)
which parcel of land is more particularly described as follows:
Beginning at a point ten (10) feet westerly of the Northeast
corner of Lot I, Block 102, City and Townsite of Aspen,
which point is situate on the North line of said Lot I,
thence Southerly on a course parallel to the East line of said
Lot I and Lot S, Block 102, to the point of intersection
with the South line of said Lot S, Block 102; thence
Westerly along the South line of said Lots and Lot R a
distance of forty (40) feet; thence Northerly and parallel
to the Westerly lines of said LotsR and Lot H, Block 102;
to the point of intersection with the Northerly line of
said Lot H; thence Easterly a distance of forty feet
along the North lot line of said Lot H and Lot I to the
point of beginning.
WHEREAS, it is to the best interests of the public to
utilize the above described strip of land for public right-of-way
purposes in lieu of the rights of way heretofore platted as public
rights of way and the City Council for the City of Aspen finds that
the public health, safety and welfare of the City of Aspen can best
be served by vacating the alley in said Block 102 and the portion
of Ute Avenue hereinafter described.
NOW, THEREFORE, be it ORDAINED BY THE CITY COUNCIL FOR THE
CITY OF ASPEN:
SECTION 1: All of the alley in Block 102 of the original
City and Townsite of Aspen, as shown upon the Official Plat of the
City of Aspen, lying between the Easterly line of Hunter Street and
the Westerly line of Spring Street, shall be and is hereby vacated
as a public alley.
SECTION 2: Ail that portion of Ute Avenue ilying
Westerly of a line described as follows: Beginning at a point
on the South lot line of Lot R, Block 102, City and Townsite of
Aspen, fifty feet Westerly of the Southeast corner of said Lot S,
Block 102; thence Southerly on a course parallel to the West lot
line of said Lot R, Block 102, to the point of intersection with
the South lime of Ute Avenue, shall be and is hereby vacated as
a public street.
SECTION 3: That there is expressly reserved from the
above vacation of said alley and street an easement for the use,
operation, construction and maintenance of public utilities to be
placed underground and overhead, including, but not exclusively,
power and telephone lines, water lines, gas mains, sewer mains and
other utilit~'~ easements of a like nature, but excluding roads and
surface easements.
