AN ORDINANCE PROVIDING FOR THE VACCINATION OF DOGS, THE ISSUANCE
OF CERTIFICATES THEREFOR AND TAGS TO BE ATTACHED TO DOG, PROVIDING
FOR THE RELEASE OF IMPOUNDED DOGS, PROVIDING FOR UNLAWFUL POSSES-
SION OF TAGS AND CERTIFICATES, FAILURE OF OWNER TO HAVE DOG
INNOCULATED AND REGISTERED AND PROVIDING FOR PENALTIES THEREFOR,
AND DECLARING AN ~MERGENCY TO EXIST.
BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ASPEN, COLORADO:
1. DEFINITIONS:
.. For the purposes of this article, the words "innocu-
lation", "vaccination," or "vaccination for rabies" shall mean the
innoculation of a dog with a vaccine approved by the State Depart-
ment of Public Health for use in the prevention of rabies.
2. ANNUAL VACCINATION OF DOGS REQUIRED. It shall be the
duty of every person who owns or harbors any dog or dogs in the
City of Aspen to have such dog or dogs innoculated by a person
legally authorized so to do. Such vaccination shall be performed
during the months of January and February for the current calendar
year; provided, however, that person who acquires any dog or dogs
between March 1 and December 31 shall ~mmediately following such
acquisition have such dog or dogs so innoculated for the remaining
portion of that calendar year.
3. CITY CLERK TO PREPARE CERTIFICATES, ETC. The City Clerk
shall prepare certificates in triplicatg..~Brm, together with corres-
ponding tags for distribution to person~ally authorized spaces
for the following information and for such other information as the City
Clerk may require to be filled in by persons legally authorized to
vaccinate dogs.
3-1. The name and address of the owner or harborer of the
innoculated dog;
3-2. The date of the innoculation;
3-3. The year and series number of the dog tag; and
3-4. The breed, age, color, and sex of the innoculated dog.
The tag shall be made of durable material suitable to be at-
tached to the collar or harness of the innoculated dog. Such tag
shall state the year for which issued and the series number of the
certificate and tag. Such tags and certificates shall be prepared
and distributed without charge by the City Clerk to persons legally
authorized to vaccinate dogs.
4. DUTY OF PERSONS PERFORMING VACCINATION. It shall be the duty
of each person legally authorized to perform vaccinations on dogs
when tnnoculattng any dog to fill out one triplicate certificate
obtained from the City Clerk with the information required by Section
3 hereof and immediately present one triplicate copy to the owner or
harborer of the innoculated dog, and to mail one triplicate copy to
the office of the City Clerk within five (5) days from the date of
the innoculation. The~maining triplicate copy of the certificate
shall be retained by the person performing the vaccination. At the
time of the innoculatton of any dog, the person performing the vac-
cination shall also deliver to the owner or harborer of said dog~
the tag obtained from the City Clerk as evidence of such innoculation.
5. TAG TO BE ATTACHED TO DOG AND CERTIFICATE RETAINED BY OWNER.
Every owner or harbor of a dog shall attach the tag evidencing in-
no~ulation with anti-table vaccine to the collar or harness of the
innoculated dog and such collar or harness shall be worn by said
dog at all times. The copy of the certificate shall be retained
by the owner or harborer of the innoculated dog for inspection by
the authorized representatives of the City Clerk.
6. REGISTRATION; PERIOD OF VALIDITY FOR CERTIFICATE AND TAG.
The City Clerk shall file and register copies of such triplicate
certificates received as provided in Section 4 and retain and file
the same as the official registry of all dogs innoculated with
anti-rabic vaccine for the City of Aspen. Such vaccination-regis-
tration shall be vaiid ~or the period of the current calendar year
and January and February of the following year.
For the period of January 1 to February 28 o~ each calendar
year, the~accination-registration from the previous year and the
current calendar year shall both be valid.
7. VACCINATION WITHOUT COST AT DISCRETION OF CITY CLERK.
The City Clerk shall at his discretion provide for the vaccination
of any dog or dogs without cost to the owner or harborer thereof in
hardship cases and in such instances that vaccination service is not
available elsewhere for a reasonable fee.
8. RELEASE OF IMPOUNDED DOGS. It is the duty of the City
Clerk or his authorized representative to release any dog from the
Dog Pound of the City of Aspen upon receipt of satisfactory proof
of ownership thereof, upon payment of any fees due the City of
Aspen under Ordinance No. 2 (Series of 1952), and upon presentation
of proof of vaccination for rabies and proper registration of said
dog in accordance with the provisions of this Ordinance.
9. IMPORTED DOGS. Ail dogs which are brought into the City
of Aspen shall be in compliance with the laws and rules and regu-
lations of the State of Colorado regarding the handling of the

animal, and shall have been vaccinated not less than thirty (30)
days, nor more than twelve (12) months prior to importation. The
metal tag denoting va0clnation shall be firmly affixed to the collar
or harness of the dog, and shall be evidence of compliance with
this section.
If said imported dog remains in Aspen more than thirty (30)
days, said dog shall be registered in accordance with the provisiqgs
of this article. Any legally acceptable certificate of vacctnati~

to the owner of the dog, in any municipality, county or state, shall
be exchanged for a current vaccination-registration tag of the City
of Aspen.
10. UNLAWFUL POSSESSION OF TAGS AND CERTIFICATES. Only those
persons who own or harbor a dog duly vaccinated in accordance with
the provisions of this article shall be permitted to possess the
certificates and tags provided for herein. No person may affix a
tag evidencing vaccination as provided herein to the collar or
harness of any dog except the tag issued for that dog at the time
of vaccination.
11. FAILURE OF OWNER TO HAVE DOG INNOCULATED AND REGISTERED.
It shall be unlawful for any person to own or harbor any dog or dogs
in the City of Aspen that have not been innoculated and registered
as provided in this Ordinance.
12. PENALTY. Any person who shall be found guilty of a
violation of any of the provisions of this Ordinance shall be
fined a sum not less than $ ~, O~ nor more than $ -~.~9o
13. 5tMERGENCY. An emergency is declared to exist and the im-
mediate passage of this Ordinance is necessary for the public peace,
health and safety of the inhabitants of the City of Aspen, Colorado,
and this Ordinance shall be in full force and effect five (5) days
after its final publicatbn.
14. Ail ordinances of the City of Aspen inconsistent herewith
to the extent of such inconsistency, and no further, are hereby
repealed.
INTRODUCED, READ AND ORDERED published as provided by law
by the City Council of Aspen, Colorado, at its regular meeting

introduced, read in full and passed first readin~ at the regular meeting
of the City Council held May 2, 1960, and published in The Aspen Times,
a weekly newspaper of ~eneral circulation published at the City of Aspen,
Colorado, in its issue of May 6, 1960, and was finally adopted and approved
on May 16, 1960, and was ordered published as Ordinance Nc. 3, (Series of 1960)
of said City as provided by law.
