HomeMy WebLinkAboutordinance.council.011-60 O~dinance No. 11, 1960 General Business Privilege ordinance - not read for the second time 4~21/61 (Series AN O~DINANCE I~OVIDIN~ FOR A PRIVILEGE TAX FOR T~E ENGAOlNO IN ANY ~O~TION, OCCUPATION OR BUSINESS IN THE CITY OF ASPEN; F~O- VIDING FOR EX~4PTIONS FRON SUCH TAX; P~OVIDING PENALTIES FOR VIOLATIONS THEREON A~ DECLARING AN ~4E~GENCY TO EXIST. BE IT O~DAINED BY THE CITY COgNCIL OF THE CITY OF ASPEN, COLORADO: SECTION l: The engaging in any vocation, occupation or business within the City of Aspen is hereby declared to be a privilege and the rate of ~ax on such privilege shall be the sum of $25.00 annually, which privilege tax ahall be paid to the City Clerk for the City of Aspen on or before February 1 of each and every year. The tax imposed by this section on each occupation, vocation or business is for the privilege of pursuing said occupation, vocation or business until the next succeeding December 31, the end of the calendar year. Any person, firm or corporation licensed under other ordinances of the City of Aspen shall be credited for ~he mount of any such fees paid thereunder against the fee provided in Section 1 hereof, and if such fee does not exceed $25.00, such person shall pay to the City Clerk the difference between the fee paid under such o~her ordinances and $25.00. If the license fee under other ordinances shall equal or exceed $25.00, then no license fee shall be charged by the Clerk under this ordinance. SECTION 2: A. Each person, 'or corporation, which is engaged in any vocation, occu~ation or business within the City of Aspen shall be liable for the payment of the privilege tax provided in Section I above. B. Any person acting as agent, trustee, ~uardian, administrator, executor, assignee or receiver, doing any of the acts herein declared to be a privilege is subject to the tax im- posed on that privilege. than C. Every person conducting a bJ~siness in more . one established place of busines~ ~1,~ liable for the pr~vilege business done at tax on D. A partnership, corporation or company shall be entitled to operate said business ~_=~=~:i~':¥~-~-"'-'~-'~-~--:-~--~----~ under a single license and the person or persons having an interest in said business shall not be separately subject to said privilege tax by reason of such interest. SECTION 3: The following acts of doing business are hereby exempted from this Ordinance: A. Newsboys sellin§ magazines or newspapers on the public street or in public places. ......... ' .... SECTION 4: Any license issued under this Ordinance shall not be transferrable except that the persons named in Section 2B shall not be required to pay a license~ for ~e remaining portion of the. calenda~ ~t~.~,7 ..... '~' ~ r SECTION 5: It shall be unlawful for any person, part- nership, company or corporation to enEage in any vocation, occupa- tion or business in the City of Aspen, unless excepted under Section 3 hereof, without first havinE procured a license therefor and having paid the licensing fee as provided in this Ordinance and any and all persons, par~erships, companies or corporations conductinE any such vocation, occupation or business in violation of this Ordinance shall he deemed ~uilty of a misd~anor and upon conviction thereof shall be fined not less than $5.00 nor more than $300.00 for each 4ay such privileEe ie exercised without a licenee. SECTION 6: If any court of competent jurisdiction should ever determine that any part of this Ordinance is invalid or un- enforceable, such determination shall not affect the remaininE parts hereof~ the intention bein§ to make the provisions herein severable. SECTION 7: An emerEency is declared to exist and the immediate paasaEe of this Ordinance is necessary for the public peace, health and safety of the inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full force and effect five (5) days after its final publication.
