AN ORDINANCE PROVIDIN~ FOR THE ISSUANCE.OF A PERMIT BY THE BUILDING
INSPECTOR FOR THE CITY OF ASPEN FOR EXCAVATION, DIGGING, OR OTHER
WORK IN ANY STREET OR ALLEY IN THE CITY OF ASPEN: PROVIDING FOR THE
RESTORATION OF ANY STREETS OR ALLEYS AFFECTED AND COLLECTION OF
COSTS AND EXPENSES THEREOF: PROVIDING FOR SPECIAL CONDITIONS AS A
PART THEREOF: PROVIDING PENALTIES FOR VIOLATIONS: AND DECLARING AN
RMERGENCY TO EXIST.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO:
SECTION 1. That no person shall excavate, dig or
otherwise interfere with the surface of any street or alley in the
City of Aspen without first obtaining a permit for such work from
the Building Inspector for the City of Aspen.
SECTION 2. Any person making any excavation, digging or
other work in any street or alley in the City of Aspen shall restore
said street to its original condition without delay and upon the
failure to restore said street or alley after receipt of 24 hours
notice from the Building Inspector, the Building Inspector may order
said street restored and payment of the costs and expenses thereof
shall be the responsibility of the person to whom such permit was
issued and upon failure to pay such costs and expenses, the City of
Aspen is hereby authorized to bring such civil action or actions in
a Court of competent jurisdiction to collect said money.
SECTION 3. The Building Inspector may from time to time
prescribe reasonable conditions prior to the issuance of any permit
taking into consideration the road surfac~ to be affected, soil
conditions, weather conditions and other special conditions and
when any such conditions are written on such permits, they shall be
considered as a part thereof and the person receiving such permit
shall be bound by the terms and conditions therein contained.
SECTION 4. It shall be unlawful for any person zo.~ke
any excavation, digging or other work in any street or alley without
first obtaining a permit so to do from the Building Inspector and
any person making any excavation, digging or other work in any
street or alley without first obtaining a permit so to do from the
Building Inspector shall be deemed guilty of a violation of this
ordinance and any person upon conviction thereof shall be fined
not less than $ /~C. k.~ nor more than $/~. ~ , ~.ach day
that such violation shall exist shall constitute a separate viola-
tion of this Ordinance.
SECTION 5. An emergency is declared to exist and the
immediate passage of this Ordinance is necessary for the public
peace, health and safety of the inhabitants of the City of Aspen,
Colorado, and this Ordinance shall be in full force and effect five
(5) days after its final publication.
INTRODUCED, READ and ORDERED published as provided by law
by the City Council of Aspen, Colorado, at its regular meeting held
at City of Aspen on this 2nd day of November, Ao D. 1959.
