AN ORDINANCE LICENSING HOTELS, MOTELS AND ROOMING HOUSES;
REGULATING THE MINIMUM FACILITIES REQUIRED FOR SUCH BUSI-
NESSES AND PROVIDING PENALTIES FOR THE ENFORCEMENT, THERE-
OF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN:
Section 1. DEFINITION. For the purpose of this ordinance
"rooming house~! shall include hotel, motel, lodging house or other places
where roomers or lodgers are received and housed or kept by the day or
week for compensation and to which the general public is received. For
the purpose of this ordinance the word "person" shall mean and include
natural persons, co-partnerships, corporations and associations.
Section Z. LICENSES. Any person desiring to operate a room-
ing house within the City of Aspen shall make written application for such
a license to the City Clerk and shall state in such application the following
information, to-wit:
(a) Name and address of owner and manager
(b) Name and address of business to be licensed
(c) Number of rooms and the number of persons that
can be accommodated in each room.
(d) Number of rooms with private bath
(e} Bath facilities forzooms without baths.
Immediately upon receipt of the application together with the
license fee as hereinafter prescribed, the City Clerk shall notify the city
inspector {which person shall be designated by the city council) who shall
inspect the premises to be licensed and the application, together with the
inspector's report shall be submitted to the City Council at its next meet-
ing. The City Inspectors shall determine if all the requirements herein
prescribed and all other requirements imposed by the City have been met.
The City Council shall approve or reject said application in writing.
Section 3. LICENSE FEES. The license fee payable hereunder
shall be the sum of $0.50 per bed according to the number of beds shown
in the application with a minimum fee of $~-. 00 and a maximum fee of
$20.00 per license.
Section 4. TERM OF LICENSES. All licenses shall be issued
for the balance of the year when granted Dr for the next ensuing year. All
licenses shall be non-transferable without the written consent of the City
Council of the City of Aspen and no license fee shall be refunded to the
holder of a license in the event the licensed premises ceases to be so
used. The City Council shall have the right to refuse an applicant when
the council has reason to believe that the applicant will not conduct the
rooming house in accordance with the ordinances of the City of Aspen or
the laws of the State of Colorado.
Section 5. REGISTRATION REQUIRED. Every person to whom
a license shall have been issued to conduct a rooming house shall at all
times keep a daily standard register in which shall be inscribed the names
of all guests or persons renting or occupying rooms which register shall
be signed by the person renting the room or rooms or by someone under
his direction. Registration as herein required shall be completed before
such person is permitted to occupy such rooms. Such register shall at
all times be open to inspection by any officer of the City of Aspen.
Section 6. MINIMUM SPACE REQUIREMENTS. No person
who owns or operates a rooming house shall rent or offer to rent any
room for sleeping purposes that does not contain a minimum of 40 square
feet of floor area for each occupant.
Section 7. RESPONSIBILITY FOR CLEANLINESS. Every
owner and manager shall at all times keep the rooming house and all
parts thereof in a clean and sanitary condition.
Section 8. PLUMBING REQUIREMENTS. At least one flush
water closet, lavatory basin and bath tub or shower, properly connected
to the water and sewer system and in good working order shall be sup-
plied for each ten persons residing within the rooming house. Every
lavatory basin, bath tub or shower shall be supplied with hot water at ail
times.
Section 9. INSPECTIONS. Wherever upon inspection of any
rooming house the City Inspector finds that conditions or practices exist
which are in violation of any provision of this ordinance or any other
ordinance of the City of Aspen, he shall give the operator notice that
unless such condition or practice is corrected within a certain period
(a reasonable time to be determined by the City Inspector) his license
will be suspended or revoked. At the end of such period the City Inspector
shall relnspect said premises and if the condition or practice has not been
corrected he shall report such fact to the City Council and such a viola-
tion of this ordinance shall be sufficient grounds to warrant the City
Council to suspend or revoke such license. Nothing herein contained
shall limit the power of city to prosecute any violators of this ordinance
as hereinafter provided without giving the notice required in this section.
Section 10. SLEEPING IN WALK WAYS PROHIBITED. No
owner or manager shall at any time permit anyone, whether a paying
guest or not, to sleep in any corridors or part of any room normally
used as a walk way or hall.
Section 11. PENALTY. Any person who shall violate any pro-
vision of this ordinance, upon conviction thereof, shall be punished by
a fine of not less than $5.00 or more than $100.00 and each day that the
violation occurs shall constitute a separate offense.
Section lg. EFFECTIVE DATE. This ordinance shall become
effective on January 1, 1955.
Section 13. UNCONSTITUTIONALITY. That if any section or
a part or a portion of this ordinance is held by a court of competent juris-
diction to be invalid or unconstitutional the remainder of the ordinance
and the application of its provisions shall not be affected thereby.
