RESOLUTION NO. ~'/
(Series of 1985)
A RESOLUTION OPPOSING THE ADOPTION OF H.B. 1271 BY THE STATE
LEGISLATURE
WHEREAS, the State Legislature is considering the passage of
H.B. 1271, ~hich ~ould reduce the authority of municipalities to
protect their drinking ~ater supplies, and
WHEREAS, the passage of H.B. 1271 :would result in certain
acitivites, with the potential to pollute municipal drinking ~ater
supplies, being unregulated, and
WHEREAS, municipalities are the best entity to monitor, pre-
serve and protect their %wn drinking ~ater supplies, and
WHEREAS, municipalities need and use the authority currently
set forth in C.R.S. (1973) Section 31-15-707(1)~b) for drinking
~ater protection programs.
NOW, THEREFORE, BE IT RESOLVED BY THE CI?Y COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The City Council of the City of Aspen, Colorado, is opposed
to the adoption of )H.B. 1271, and is opposed to any legislative
action designed to weaken the po~ers granted to municipalities to
protect their drinking ~ater set forth in C.R.S. (1973) Section
31-15-707(1)(b). Therefore, the City Council urges members of the
State Legislature to reject H.B.
(1973) Section 31-15-707(1)(b).
Section 2
The Mayor,
authorized and
City Manager,
encouraged to
1271 and any changes to C.R.S.
City Attorney and City Staff are
take all necessary action to oppose
the adoption of H.B. 1271, and to communicate the threat posed by
H.B. 1271 to other municipalities, public officials and the public
at large.
