HomeMy WebLinkAboutresolution.council.021-85RESOLUTION NO. 2~ (Series of 1985) A RESOLUTION DIRECTING THE EXERCISE OF THE CITY'S OPTION TO PURCHASE UNIT 2, CHAPMAN CONDOMINIUMS; APPROVING THE CONVEYANCE OF SAID CONDOMINIUM UNIT TO ELYSE ELLIOTT AND HER HUSBAND, JEREMY B ERNSTEIN, PURSUANT TO THE TERMS OF THE PURCHASE AND OPTION AGREEMENT ANNEXED HERETO; AND AUTHORIZING THE CITY MANAGER AND/OR MAYOR TO EXECUTE SUCH DOCUMENTS AS MAY BE APPRO- PRIATE TO CONSUMMATE THE TRANSACTION WHEREAS, pursuant to that Purchase, Sale and option Agree- ment dated September 10, 1982, between the City of Aspen and Colette Penne, Glenn Horn and Alice Davis, the City has the right to exercise its option to purchase that property commonly known as 717 Cemetery Lane and more specifically described as: Unit 2, Chapman Condominiums (a condominium) according to the condominium map appearing in the records of the County Clerk and Recorder of Pitkin County, Colorado, in Plat Book 10 at Page 33 as Reception No. 226253, and as further defined and described in the Condominium Declaration thereof recorded August 26, 1980, in Book 393 at Page 663 as Reception No. 226252. and, WHEREAS, the City Council desires to exercise its option to purchase the above-described property and to convey the same to Elyse Elliott and her husband, Jeremy Bernstein, on the terms and conditions set forth in the Purchase and Option Agreement among the City of Aspen and Elyse Elliott and her husband, Jeremy Bernstein, annexed hereto and made apart hereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: The City Council does hereby authorize and approve the exercise of the City's option to purchase Unit 2, Chapman Condominiums, as hereinabove described and the conveyance of said unit to Elyse Elliott and her husband, Jeremy Bernstein, in accordance with the terms of the Purchase and Option Agreement among the City of Aspen and Elyse Elliott and her husband, Jeremy Bernstein, annexed hereto. Said agreement has been modified as necessary to consummate the transaction with prior approval by the City Attorney and the Mayor, by adding Jeremy Bernstein as a Purchaser under the agreement due to requirements of the purchasers' lender. Section 2 The City Manager and the Mayor are each authorized to execute such documents on behalf of the City as may be deemed necessary to consummate and ratify the aforesaid transactions. , 1985.
