RESOLUTION NO. ~

WHEREAS, in accordance with Section 24-11.4(a) of the Municipal
Code, as amended, December 1st of each year is established as a deadline
for submission of applications for residential development allotments within
the City of Aspen, and
WHEREAS, in response to this provision, three projects were submitted
for evaluation, involving a total of seven free market units and six employee
units, identified as follows:
Whale of a Wash - 1 free market unit, 1Silverking unit converted
by deed restriction.
lll W. Hyman - 1 free market and 1 employee unit.
Snowridge - 5 free market and 5 employee units, and
WHEREAS, according to the records of the Planning Office and the Building
Department, there are 120 units available for allocation due to recent build-
out rates and the expiration of allocations granted in prior years, and
WHEREAS, a duly noticed public hearing was held on January 18, 1983, by
the Aspen Planning and Zoning Commission to consider the Growth Management
applications and evaluate and score them in conformance with criteria esta-
blished in Section 24-11.4(b) of the Code, and
WHEREAS, the Planning and Zoning Commission did evaluate and score the
projects submitted and only the Whale of a Wash project successfully met the
minimum required threshold of 43.8 points, with the point totals awarded as
follows:
Whale of a Wash: 45.1
III W. Hyman: 42.5
Snowridge: 37.7, and
WHEREAS, the Aspen City Council did review the recommended Planning and
Zoning scoring at their meeting on February 28, 1983, including an appeal of
the scoring of the lll W. Hyman project, and
WHEREAS, the Aspen City Council did deny the appeal of the scoring of
the 111W. Hyman project and did accept the recommended scoring of the three
projects by the Planning and Zoning Commission, thereby effectively approving

the Whale of a Wash project and denying the lll W. Hyman and Snowridge
projects, and
WHEREAS, the Aspen City Council did consider a recommendation by the
Planning Office that the residential quota which is unallocated following
the 1983 competition not be carried over to the following year, as provided
by Section 24-11.4(g) of the Municipal Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,COLORADO
that a residential development allocation for one free-market unit is hereby
awarded to the Whale of a Wash project and the project may proceed further
with the additional approvals required by the City of Aspen before a building
permit is secured.
BE tT ALSO RESOLVED BY THE CITY COUNCIL OF ASPEN, COLORADO that it
does hereby determine that the 119 residential development allotments which
remain as unallocated from previous years shall not be carried over for award
during future years, as provided under Section 24-11.4(g) of the Municipal
Code.
