HomeMy WebLinkAboutresolution.council.016-82RECORD OF PROCEEDINGS 1 O0 Leaves RESOLUTION NO. 98~2) (Series of 1 A RESOLUTION SUBMITTING TO A VOTE OF THE QUALIFIED REGISTERED ELECTORS OF THE CITY OF ASPEN, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD ON JUNE 15, 1982, A QUESTION REGARDING THE APPROVAL OF THE SALE BY THE CITY COUNCIL OF THAT REAL PROPERTY AND THE CITY-OWNED HOUSING PROJECT SITUATED THEREON, COMMONLY KNOWN AS THE "CASTLE RIDGE APARTMENTS", LOCATED WITHIN THE CITY OF ASPEN, COUNTY OF PITKIN, ON CASTLE CREEK ROAD (ADJACENT TO THE ASPEN VALLEY HOSPITAL) WHEREAS, the City of Aspen is the owner of certain real pro- perty and the housing project situated thereon (consisting of eighty (80) apartments units), commonly known as the "Castle Ridge Apartments", located within the City of Aspen, County of Pitkin, on Castle Creek Road (adjacent to the Aspen Valley Hospital); and WHEREAS, the City Council has received several unsolicited proposals to purchase the aforesaid Castle Ridge Apartments; and WHEREAS, Section 13.4 of the City Charter provides that the City Council shall not sell, exchange or dispose of either public buildings or real property currently in use for public purposes without first obtaining the approval of a majority of the electors voting thereon; and WHEREAS, in the event the City Council deems it to be in the best interest of the City of Aspen to accept one of the aforesaid offers, the City Council desires to submit to the qualified elec- tors of the City of Aspen a question concerning the sale of the "Castle Ridge Apartments", which transaction would include the following general terms: 1. The value paid by the purchaser (i.e., total of sales price, fees and commissions) shall not be less than Four Million Four Hundred Seventy-five Thousand Dollars ($4,475,000), payable on such terms as the City Council deems appropriate. 2. As a condition of sale, the purchaser shall agree to and, in fact, must deed restrict and maintain all eighty (80) RECORD OF PROCEEDINGS 100 Leaves apartment units in the Castle Ridge Apartments as employee housing subject to the applicable employee housing guidelines established by the City Council for such project. 3. As a condition of sale and in addition to the value paid by the purchaser, the purchaser shall be required to provide land- scaping, paving and make such other improvements as are deemed desirable by the City Council, in an amount of not less than Two Hundred Thousand Dollars ($200,000). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That at the special election to be held in the City of Aspen, Colorado, on Tuesday, June 15, 1982, there shall be submitted to a vote of the qualified, registered electors of the City, a question relating to the sale of that real property and the housing project situated thereon, commonly known as Castle Ridge Apartments, all as further set forth below and as more particularly stated in the form of Ballot Label and Notice of Election hereinafter set forth. FORM OF QUESTION QUESTION NO. 3 Shall the sale by the City Council of that real property and the employee housing project situated thereon, commonly known as the Castle Ridge Apartments, consisting of eighty (80) apartment units, located in the City of Aspen, County of Pitkin, on Castle Creek Road (adjacent to the Aspen Valley Hospital) be approved pursuant to Section 13.4 of the City Charter. Any such sale of the Castle Ridge Apartments would be in response to several unsolicited offers presented to the City Council. No offer would be accepted or sale consummated unless the following are met: The value paid by the purchaser (i.e., total sales price, fees and commissions) shall not be less than Four Million Four Hundred Seventy-five Thousand Dollars ($4,475,000), on such terms as the City Council may deem appropriate. Section 2 Those qualified, registered electors of the City who are qualified to vote under the Constitution and the Charter of the City of Aspen shall be allowed to vote on the proposed question. Section 3 In accordance with Ordinance No. 14, Series of 1982, there shall be one municipal election precinct for the election on the proposed question at the Upper Elementary School Gym, 110 East Hallam, Aspen, Colorado, between the hours of 7:00 a.m. and 7:00 p.m. on June 15, 1982; the election shall be conducted in accord- ance with the provisions of Ordinance No. 14 (Series of 1982). Section 4 The votes at said election shall be registered on electronic voting machines at the polling place and the following question shall be added to the Ballot Label: QUESTION 3: "FOR AGAINST Shall the sale by the City Council of that real property and the employee housing project situated thereon, commonly known as the Castle Ridge Apartments, consisting of eighty (80) apartment units, located in the City of Aspen, County of Pit- kin, on Castle Creek Road (adjacent to the Aspen Valley Hos- pital) be approved pursuant to Section 13.4 of the City Char- ter. Section 5 The election on the question shall be held and conducted and the votes cast on the question aforesaid shall be returned and canvassed, and the result declared in the same manner as nearly as may be provided by law for the return, canvass and declaration of the result of the votes officers in the City of 14, Series of 1982. Secton 6 cast at the general election of municipal Aspen, all as provided in Ordinance No. Notice of the election on the proposed question shall be pub- lished in the Aspen Tim~s, a newspaper published and of general circulation in said City, in the edition of said newspaper dated ~,4~ ~ ~~ /~, 1982. A copy of such notice shall be posted at each polling place within the City, at least ten (10) days before the election. The City Clerk is hereby charged with the duty of giving such notice. Said notice shall, in addition to other notices with respect to the calling of this special municipal election, be in substantially the following form: "PUBLIC NOTICE OF THE SUBMISSION OF A PROPOSED QUESTION TO THE VOTERS OF THE CITY OF ASPEN, COLORADO, AT A SPECIAL ELECTION, TO BE HELD ON JUNE 15, 1982 of the City Council of the City of PUBLIC NOTICE IS HEREBY GIVEN that, pursuant to a resolution Aspen, Colorado, at a Special 4 RECORD OF PROCEEDINGS 100 Leaves Municipal Election to be held in the City on Tuesday, June 15, 1982, between the hours of 7:00 a.m. and 7:00 p.m., there will be submitted a proposed question as follows: Shall the sale by the City Council of that real property and the employee housing project situated thereon, commonly known as the Castle Ridge Apartments, consisting of eighty (80) apartment units, located in the City of Aspen, County of Pitkin, on Castle Creek Road (adjacent to the Aspen Valley Hospital) be approved pursuant to Section 13.4 of the City Charter. Those electors who are otherwise fully qualified to vote on said question at such election, but who are or will be unable to appear at the polling place on the date of the election, may apply in writing at the office of the City C~erk, at City Hall, for an absentee ballot at any time during business hours on or before the It~ day of ~, 1982. The votes cast shall be recorded on voting machines and said election shall be held, conducted and the returns thereof shall be returned, canvassed and declared, as nearly as may be in the man- ner prescribed by law for the general election of municipal offi- cers.
