A RESOLUTION CALLING A SPECIAL MUNICIPAL ELECTION IN THE CITY OF
ASPEN, COLORADO, TO BE HELD ON NOVEMBER 2, 1982, AND SETTING FORTH
THE PURPOSE OF SUCH ELECTION
WHEREAS, the City of Aspen, Colorado (the "City"), in the
County of Pitkin and State of Colorado, is a municipal corporaton
duly organized and existing as a home rule city pursuant to Arti-
cle XX of the Colorado Constitution; and
WHEREAS, Section 2.2 of the Charter of the City (the "Char-
ter'') provides that any special municipal election may be called
by a resolution or ordinance of the City Council (the "Council")
at least 60 days in advance of such election, and that such reso-
lution or ordinance shall set forth the purpose or purposes of
such election; and
WHEREAS, the Council, by Resolution No. 20, Series of 1982,
has heretofore called a special municipal election to be held on
September 28, 1982; and
WHEREAS, Council has now determined that it is necessary and
advisable to cancel the special election so called and to call,
pursuant to Section 2.2 of the Charter, a new special municipal
election as herein provided.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1. The Council hereby calls a special municipal
election (the "Election") to be held on November 2, 1982, at the
same time as the general election.
Section 2. The purpose of the Election is to submit to the
qualified electors of the City questions concerning:

a. Authorization for the issuance of the City's sales tax
revenue bonds for the purpose of restoring, improving
and equipping the Wheeler Opera House;
b. Authorization for the sale of the Wheeler Opera House
and its simultaneous lease back;
c. Authorization for the utilization or possible conveyance
of a portion of that City-owned parcel of land, commonly
known as the Thomas Property (currently in use as open
space), for purposes of extending State Highway 82.
Section 3. Pursuant to Section 2.1 of the Charter, the Elec-
tion shall be conducted in the manner prescribed by the Colorado
Municipal Election Code of 1965, as amended and supplemented,
except as otherwise provided in the Charter or by ordinance. The
Council shall, by ordinance or ordinances hereafter enacted, fix
the election questions to be submitted, establish precincts and
polling places, and otherwise provide for the Election.
Section 4. The officers of the City are hereby authorized
and directed to take all action necessary or appropriate to effec-
tuate the provisions of this resolution, including without limita-
tion the publication in the Aspen Times on or before September 24,
1982, of a notice that registration for such election will close
on October 1, 1982.
Section 5. All resolutions, bylaws and regulations of the
City in conflict with this resolution are hereby repealed to the
extent of such conflict, including without limitation Resolution
No. 20, Series of 1982; and the special municipal election sche-
duled to be held on September 28, 1982, is hereby cancelled.
Section 6. This resolution shall take
upon its passage.
ADOPTED AND APPROVED on this August 31,
effect immediately
