HomeMy WebLinkAboutresolution.council.031-82 100 Leaves RECORD OF PROCEEDINGS RESOLUTION NO. _ (Series of 19]~-~) A RESOLUTION AUTHORIZING CERTAIN FULL-TIME EMPLOYEES OF THE FINANCE DEPARTMENT TO FILE AND PROSECUTE CLAIMS ON BEHALF OF THE CITY OF ASPEN IN THE SMALL CLAIMS DIVISION OF THE PITKIN cOUNTY COURT WHEREAS, the City of Aspen, Colorado, a municipal corporation and home-rule City, is a creditor with respect to a significant number of debts in the amounts of approximately One Thousand Dol- lars ($1,000.00) or less; and WHEREAS, the legislature of the State of Colorado has created a small claims division in the various county courtS of the state, including Pitkin County, to assist creditor claimantS in securing a non-technical legal forum to litigate debt claims in the amountS of approximately One Thousand Dollars ($1,000.00) or less; and WHEREAS, it is the expressed intent of the legislature to exclude attorneys from practice before the Small Claims Division; and wHEREAS, a municipal corporation may file claims and be represented in the Small Claims Division by a full-time officer or employee of the corporation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY cOUNCIL OF THE CITY OF ASPEN, COLORADO: S~ection !. That the Finance Director of the City of Aspen hereby is authorized, after advice from the City Manager and the City Attor- ney, and as a last resort of collection, to file such claims in the Small Claims Division of the County court of Pitkin County, State of Colorado, as are lawful and, in the Finance Director advised discretion, represent just debts owed to the City of Aspen. The Finance Director shall further have the discretion, after advice from the City Manager and City Attorney, to waive RECORD OF PROCEEDINGS 100 Leaves in excess of the jurisdictional limit of the in order to meet the jurisdiction of the small amounts owed Small Claims Division, Small Claims Division. Section 2 That the Finance Director of the City of Aspen hereby is authorized to authorize, by a writing to that effect, a full-time employee of the Finance Department to file and prosecute claims on behalf of the City of Aspen in the Small Claims Division of the County Court of Pitkin County, State of Colorado.
