HomeMy WebLinkAboutresolution.council.038-82RECORD OF PROCEEDINGS 100 Leaves RESOLUTION NO. 38 (Series of 1982) A RESOLUTION CALLING A SPECIAL MUNICIPAL ELECTION IN THE CITY OF ASPEN, COLORADO, TO BE HELD ON FEBRUARY 15, 1983, AND SETTING FORTH THE PURPOSE OF SUCH ELECTION WHEREAS, the City of Aspen (the "City"), in the County of Pitkin and State of Colorado, is a municipal corporation duly organized and existing as a home rule city pursuant to Article XX of the Colorado Constitution; and WHEREAS, Section 2.2 of the Charter of the City (the "Charter") provides that any special municipal election may be called by a resolution or ordinance of the City Council (the "Council") at least 60 days in advance of such election, and that such resolution or ordinance shall set forth the purpose or purposes of such election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The Council hereby calls a special municipal election (the "Election") to be held on February 15, 1983. Section 2 The purpose of the Election is to submit to the qualified electors of the City a question concerning: a. Authorization to lease a portion of that City-owned land commonly known as Rubey Park for the purpose of developing a visitor/transportation center with accessory commercial space. Section 3 Pursuant to Section 2.1 of the Charter, the Election shall be conducted in the manner prescribed by the Colorado Municipal RECORD OF PROCEEDINGS 100 Leaves Election Code of 1965, as amended and supplemented, except as otherwise provided by the Charter or by ordinance. The Council shall, by ordinance or ordinances hereafter enacted, fix the election questions to be submitted, establish precincts and polling places, and otherwise provide for the Election. Section 4 The officers of the City are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this resolution, including without limitation the publication in the Aspen Times on or before January 6, 1983, of a notice that registration for such election will close on January 14, 1983. Section 5 All resolutions, bylaws and regulations of the City in conflict with this resolution are hereby repealed to the extent of such conflict. Section 6 This resolution shall take effect immediately upon its passage. Dated: I, Kathryn S.
