IQ A RESOLUTION CONCERNING THE SUBMISSION OF A G~IgERAL OBLIGA- TION BOND QUESTION AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON MAY 5, 1981; AND PROVIDING DETAILS IN CONNECTION THEREWITH. WHEREAS, the City of Aspen, Colorado (the "City" and the "State," respectively), is a political subdivision of the State, a body corporate and politic, and a home rule city pursuant to Article XX of the State Constitution; and WHEREAS, the City Council of the City has determined that while not required by the Charter of the City (the "Charter"), it is desirable to submit to the qualified electors of the City a question concerning the issuance of general obligation water bonds. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. At the general municipal election to be held in the City on Tuesday, May 5, 1981, there shall be submitted to the registered qualified electors of the City the following general obli- gation water bond question: GENERAL OBLIGATION WATER BOND QUESTION: "Shall the City of Aspen, Colorado, be authorized to isssue its negotiable, coupon, general obligation bonds, in one series or more, in an aggregate principal amount of not exceeding $9,000,000 for the purpose of improving and extending the City's water system, including without limi- tation the acquisition of water rights, such bonds to be paid from water system revenues insofar as possible, to bear interest at a net effective interest rate not to exceed ten and three-quarters percent (10-3/4%) per annum, to mature at such time or times not exceeding 25 years from their date or respective dates, and otherwise to be sold and issued in such manner and upon such terms and condi- tions as the City Council may determine, including, at its option, provisions for the redemption of bonds prior to maturity with or without a premium?" (the "Bond Question") Section 2. Pursuant to Section 2.1 of the Charter, the election on the Bond Question (the "Bond Election") shall be governed by the Colorado Municipal Election Code of 1965, as ~mended, except as otherwise provided by the Charter or by ordinance. Section 3. An electronic voting system shall be used for the Bond Election. Section 4. No vote for or against the Bond Question shall be received unless the person offering the same shall be a registered -1- qualified elector of the City, as defined by the Charter and the Constitution and laws of the State. Section 5. The following precincts and polling places heretofore established by ordinance for the general municipal elec- tion shall be the precincts and polling places for the Bond Election: 1 2 3 4 Section public notice of St. Mary's Church, 533 East Main Street Chateau Dumont, 731 East Durant Upper Elementary School Gym, 110 East Hallam Physics Center, 700 Gillispie Plum Tree Inn, Highway 82 6. The Election Commission of the City shall give the Bond Election: (a) By publishing such notice in the Aspen Times, a weekly newspaper of general circulation in the City, such publication to be in the next to the last issue of such newspaper before the Bond Election. (b) By posting such notice conspicuously, at least ten (10) days before the Election, at each of the polling places. Section 7. Notice of the Bond Election shall be in sub- stantially the following form: -2- (Form of Notice) NOTICE OF SUBMISSION OF A BOND QUESTION AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, MAY 5, 1981 IN THE CITY OF ASPEN. COLORADO The Election Commission of the City of Aspen, Colorado (the "City" and the "State," respectively), DOES HEREBY GIVE PL~LIC NOTICE that there shall be submitted to the registered qualified electors of the City at the general municipal election to be held on Tuesday, May 5, 1981, the following general obligation bond question: GENERAL OBLIGATION WATER BOND QUESTION: (Insert in the notice as printed the text of the General Obigation Water Bond Question set forth in Section 1 of this resolution.) The following precincts and polling places for the general municipal election shall be the precincts and polling places for the election on the general obligation water bond question (the "Bond Election"): 1 2 3 4 5 St. Mary's Church, 533 East Main Street Chateau Dumont, 731 East Durant Upper Elementary School Gym, 110 East Hallam Physics Center, 700 Gillispie Plum Tree Inn, Highway 82 The provisions of the Colorado Municipal Election Code of 1965, as amended, shall govern the Bond Election, except as otherwise provided by the City Charter or by ordinance. The polls shall be open at 7:00 o'clock a.m. and shall be closed at 7:00 o'clock p.m. Absentee voting for the Bond Election shall be permitted as provided by law. No vote will be received at the Bond Election unless t~e person offering to vote shall be at least eighteen years of age and a citizen of the United States, who shall have resided in the election precinct thirty-two days immediately preceding the Bond Election, and who shall also be registered as provided by law; e~ept that an oth- erwise qualified and registered elector who moves from the election precinct where registered to another precinct within the City within thirty-two days prior to the Bond Election shall be permitted to cast his ballot at the polling place in the precinct where registered. -3- of Aspen IN TESTIMONY WHEREOF, the Election Commission of the City has caused this notice to be published this .... day of , 1981. The officers of the City be, and they hereby are, authorized and directed to take all action necessary or appro- priate to effectuate the provisions of this resolution, including without limitation the publication of a notice regarding the close of registration for the Bond Election. Section 9. If any section, paragraph, clause or provision of this resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this resolution. Section 10. All resolutions, bylaws and regulations of the City in conflict with this resolution are hereby repealed to the extent only of such inconsistency.
