HomeMy WebLinkAboutresolution.council.043-81RECORD OF PROCEEDINGS 100 Leaves RESOLUTION OF THE ASPEN CITY COUNCIL GRANT~NG~,~ SPECIAL REVIEW EXEMPTION TO THE ED BAKER DUPLEX O~Y~AN AVENUE FROM THE MORATORIUM IN THE R-MF ZONE DISTRICT RESOLUTION NO. .~ (Series of 1981) WHEREAS, on August 24, 1981, the Aspen City Council did adopt Ordinance No. 50, Series of 1981, imposing a 3-month moratorium on the construction and/or expansion of ali buildings located in the R-MF zone district, and WHEREAS, Section 3 of said ordinance provides that City Council may, by resolution, exempt an application already in the review process from the restrictions of the moratorium if, upon special review and considering the recommendation of the Planning Office, the City Council finds that the area and bulk of the pro- posed new building or expansion of an existing building is reason- ably compatible with requirements currently in existence and those under consideration for the R-MF zone district, and WHEREAS, the Ed Baker Duplex on~Hyman Avenue is exempt from compliance with the GMP under the provisions of Section 24-11.2(c) of the Aspen Municipal Code and is not required to proceed through the requirements of the subdivision regulations prior to receipt of a building permit, and WHEREAS, the issuance of a building permit for the Ed Baker Duplex on~Hyman Avenue has been held in abeyance pending the imposition of the moratorium in the R-MF zone district, and WHEREAS, the Planning Office has carefully reviewed the area and bulk of the proposed Ed Baker Duplex on/~yman Avenue and based on the applicant's proposal to reduce its height by three (3) feet to twenty-nine (29) feet and to reduce its bulk by one and one- half (1 1/2) feet on all sides, limiting its floor area to approx- intately 8,200 square feet, an FAR of 0.9:1, finds it reasonably RECORD OF PROCEEDINGS 100 Leaves compatible with the requirements currently in existence and those under consideration for the R-MF zone district, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO; Section 1 That it does hereby grant special review exemption to the Ed Baker Duplex on Hyman Avenue from the moratorium on the construc- tion of new Duiidings in the R-MF zone district. Section 2 That the exemption of the Ed Baker Duplex on Hyman Avenue is hereby conditioned on the applicant's agreement to abide by the limitations included in the letter from Ronald D.
