HomeMy WebLinkAboutresolution.council.051-81RECORD OF PROCEEDINGS 1 O0 Leaves RESOLUTION NO. 51 (Series of 1981) A RESOLUTION ESTABLISHING A PROGRAM FOR INSPECTION AND UPGRADING OF EXISTING DORM LODGES WITHIN THE CITY OF ASPEN WHEREAS, the City Council recognizes that all of the dorm lodges presently existing within the City of Aspen were con- structed prior to the City's adoption of the 1979 Uniform Building Code; and WHEREAS, the City recognizes the importance and value of the existing dorm lodges to the City of Aspen and that the imposition of strict code requirements will affect the economic viability of such lodges; and WHEREAS, the dorm lodge owners have requested the City Coun- cil to establish a program for inspecting and upgrading existing dorm lodges to bring them, as far as is economically practicable, into compliance with health and safety standards, so that the lodge owners, by participating in the program, can have assurance that their lodge is in compliance with City requirements concern- ing building code regulations; and WHEREAS, the City Council deems it to be in the best interest o~ the City of Aspen, its citizens and visitors, to adopt a pro- gram for inspecting and upgrading dorm lodges, as far as is eco- nomically practicable and consistent with standards of health and safety. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The City Council hereby establishes the following program for inspection and upgrading o~ aorm lodges presently existing within the City of Aspen: RECORD OF PROCEEDINGS 100 Leaves his employees shall endeavor to inspect all lodges within the City of Aspen. 2. Following the inspection of a particular lodge, the Building Inspector shall, if appropriate, make reco~endations to The Chief Building Inspector of the City of Aspen and of the existing dorm as far as is economically and safety standards of the lodge owner for bringin9 his lodge, practicable, into compliance with life City of Aspen codes. It is the intent of this resolution that the dorm lodges in existence prior to the effective date of the 1979 Uniform Building Code De brought into compliance only if so far as is reasonably and economically practicable and with the goa± of maintaining the economic viability of such lodges. 3. In the event that a dorm lodge owner does not feel that the reconm~endations of the Building Inspector are, in fact, fair and within the intent of this resolution, the lodge owner shall have the right to appeal any reco~mzendation or requirement of the Building Inspector to the City Council, provided that all appeals to the Board of Appeals and Examiners have been exhausted. 4. Upon filing with the Building Inspector's Office of a simple drawing of the lodge (which drawin9 shall include basic dimensions of the lodge, room locations, exits and stairs, and s~a±l indicate an accurate pillow count by room and bed configu- ration) and, also, upon compliance with the recommendations of the Building Inspector as [nay De modified by administrative appeal, the Building Inspector shall issue a certificate of occupancy whic~ shall certify that the lodge is in compliance witQ the requirements of the City of Aspen with respect to Building Code regulations in effect as of the date of this resolution. The program £or inspection and upgrading of existing dorm lodges set forth herein shall become effective immediately, and the Chief Building Inspector is hereDy directed to implement the program as quickly as possible.
