WHEREAS, the 1980 Housing Action Plan has identified a low-,
moderate- and middle-income housing shortfall of over 250 units;
and

opment of deed-restricted low- and moderate-income housing on a
case-by-case basis;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO;
Henceforth, all Park Dedication fees shall be waived for
low- and moderate-income housing, provided that the deed
restriction is for a period of not less than fifty (50) years and
that the restriction is one that runs with the land.
Park dedication fees shall be deferred for housing that is
owned by a non- profit organization and is used solely by that
organization as housing for its employees within the low- and
moderate-income guidelines, as established by the City, for as
long as the housing is used solely as employee housing by the
employees of the organization.
If the said housing is sold by the organization or rented on
the free market or ceases to be used as employee housing by the
employees of the organization, the park dedication fees shall
immediately be due and payable to the City. All fees due shall be
assessed at the market value of the subject property as of the day
they become due and payable.
