RESOLUTION NO. ~
(Series of 1979)
WHEREAS, a public hearing has been conducted on March 26,
1979, to determine whether or not to establish an additional
pedestrian mall in the Aspen commercial core as proposed in
Resolution No. 1, Series of 1979, and
W~EREAS, the Aspen City Council, after considering the
record of the proceeding, and written presentations from abutting
property owners and the public at large in favor of or opposing,
objecting to, or protesting the proposed pedestrian mall, has
determined that:
1. All notice requirements prerequisite to said hearing
as required by Section 31-25-405, C.R.S. 1973, as amended,
the Colorado Public Mall Act of 1970, have been satisfied,
and the public hearing properly conducted,
2. Written objections and written protests to the estab-
lishment of the proposed pedestrian mall have been filed
by owners of lands abutting the proposed mall representing
O % of the frontage of the proposed mall, which protests
constitute less than a majority of the frontage affected,
and the question of establishing the proposed mall need
not be submitted to the electorate for approval, however,
consistent with Resolution No. 2, Series of 1979, a referen-
dum shall be held on said question, and
3. Proceedings should continue to establish the proposed
mall all as described in the said Public Mall Act of 1970.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
That the City Council does hereby determine that the following
portions of the public streets within the City of Aspen shall
be established as a pedestrian mall:
RECORD OF PROCEEDINGS
(a) That section of Cooper Avenue from Galena Street to
Hunter Street;
(b) That section of Galena Street from Hyman Avenue to
Cooper Avenue;
(c) A portion of the intersection of Hyman Avenue and
Galena Street; and
(d) The intersection of Cooper Avenue and Galena Street.
All as more particularly described in Resolution No. 1,
Series of 1979.
~E IT FURTHER RESOLVED that if a majority of those voting
on the question submitted by Resolution No. 2, Series of 1979,
vote in favor of establishing such proposed pedestrian mall there
be presented to the City Council for its consideration and first
reading on May 14, 1979, an ordinance prohibiting (in whole or
in part) vehicular traffic on such mall areas, prior to which
time there shall be filed with the City Clerk any and all claims
for damages authorized by Section 31-25-406, C.R.S. 1973, as
amended.

AND BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO

RE: WHITE RIVER NATIONAL FOREST BOUNDARY EXTENSION
WHEREAS, the United States Forest Service, Department of Agriculture,
has accumulated certain lands in Pitkin County in the vicinity of Hunter Creek
and Smuggler Mountain which lie within the present boundaries of White River
National Forest, and
WHEREAS, it is the policy of the Board of County Commissioners of Pitkin
County and the City Council of Aspen to encourage the United States Forest Service
to acquire additional lands in said area, by gift, purchase, exchange or otherwise
for the preservation of open space and lands suitable for recreational opportunities
of the residents and visitors to Pitkin County,
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of
Pitkin County, Colorado, and the City Council of Aspen, Colorado, support and
encourage an extension of the boundaries of White River National Forest north
and east of the City of Aspen through support of H.R. 1967, which includes the
following lands, containing 2,416 acres more or less:
Township l0 south, range 85 west, sixth principal meridian:
Section 1, lots 1-7; and
Township l0 south, range 84 west, sixth principal meridian:
Section 5: entire;
Section 6: north half, and southeast quarter except that part platted
as a portion of the Red Mountain subdivision;
Section 7: east half of the east half, and that part of lot 27 outside
the east half of the east half; Section 8: entire;
Section 17: east half, north half of the northwest quarter, and lots
1, 3 and 6.
Section 18: that part of the northeast quarter of the northeast quarter
bounded by M.S. 3905, M.S. 6120 and M.S. 6899.
BE IT FURTHER RESOLVED that the Clerk of the City of Aspen transmit
certified copies of this Resolution forthwith to the Superintendent of White
River National Forest, the Regional Forester at Denver, the Chief of the United
States Forest Service, and each congressman from the State of Colorado.
