RESOLUTION NO. 11
(Series of 1976)
WHEREAS, the Planning & Zoning Commission has forwarded
to the Aspen City Council a series of recommendations for changes
to the Aspen Zoning Code, and
WHEREAS, the Aspen City Council is of the opinion that
two of said recommendations are of questionable merit but that
the interim effects of these P&Z recommendations has created a
hardship to certain landowners by postponing consideration of their
pending building permit applications, and
WHEREAS, the City Council may, pursuant to Section 24-11.7(a)
refuse to further consider any of the recommendations and thus
permit issuance of any building permit applied for which otherwise
conforms to the city's existing zoning regulations, and
WHEREAS, the City Council wishes to exercise this pre-
rogative with respect to the two recommendations hereinafter
described,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
That it does hereby refuse to further consider the follow-
ing recommendations of the Planning and Zoning Commissi°n~
included in the Commission's resolution dated April 2, 1976,
1. Section 1.a of said resolution recommending the
establishment of an internal FAR in the CC district.
2. Section 4 of the resolution to the extent that it
includes sub-basement and storage areas in calculating
the external FAR in the CC district.
BE IT FURTHER RESOLVED that the City Council directs the
Planning office to reconsider planning objectives for the commercial

district and present their recommendations for appropriate
code changes to the Planning Commission with all diligence.
