HomeMy WebLinkAboutresolution.council.040-74RECORD OF PROCEEDINGS 100 Leaves RESOLUTION NO. 40 (Series of 1974) WHEREAS, the U. S. civil Aeronautics Board did in its Order 74-10-118 deny the Petition for Reconsidera- tion of Rocky Mountain Airways (RMA), Inc., for an exemption pursuant to Section 416(b) of the Federal Aviation Act of 1958, as amended, and WHEREAS, by the denial of the petition the Board reinstated the earlier denial of the RMA application for an exemption to utilize two turbo-prop F-27 aircraft with a maximum seating capacity of 40 passengers in (1) scheduled air transportation between Denver and Aspen, Colorado, and between Denver and Aspen via the intermediate point vail/Eagle and (2) off route charter operations, subject~ to the limitation that such large aircraft operations not exceed 50 per cent of the base-miles flown by it in scheduled service with large aircraft, for a five year period, and WHEREAS, in denying the application, the Board concluded, in essence, that RMA's proposed turbo-prop operation would result in divers'ion from certified operations without sufficient compensating public benefits, and WHEREAS, the Aspen City Council wishes to state its opposition to this determination and request recon- sideration of the same, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: 1. That it does question the determinations made by the civil Aeronautics Board in its original Order 74-7-107, dated July 24, 1974, and its order denying the RMA Petition for Reconsideration, 74-10-118, and wishes to RECORD OF PROCEEDINGS 100 Leaves make a request that the applications made by RMA for extended service be given additional consideration. 2. That the City Council of the City of Aspen does further contend that the request made is appropriate and the service extension a necessary adjunct to the Sardy Field Airport services offered to the City of Aspen and Pitkin County, with their tourist economy. 3. That the City Attorney forward a copy of this Resolution at her earliest convenience to the Civil Aeronautics Board, Washington, D.C. so as to apprise the Board of this action taken.
