(Series of 1974) WHEREAS, the City Council has been apprised of the contemporary problems created by the criminalization of the use and possession of small amounts of marijuana, especially with the youth in the Aspen Community and nationwide, and WHEREAS, the Aspen City Council wishes to voice its opinion and adopt the stance of the American Bar Association, the National Commission on Marijuana and Drug Abuse, the National Council of Churches, and many other organizations with respect to the decriminalization of such use and possession, and WHEREAS, the Aspen City Council wishes, as a caveat to any such expression of its opinion, to declare that it does not endorse the use or sale of marijuana or encourage any such illegal activity, now THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: 1. That it does recommend and encourage the state authorities to (1) eliminate all criminal laws punishing the possessions of small amounts of marijuana, (2) treat the casual distribution of small amounts of marijuana not for profit as simple possession, and (3) establish regulatory schemes governing the distribution of marijuana. 2. That the position here taken not be interpreted as an endorsement of any activity, either in Aspen or elsewhere, which is at present an illegal activity, with respect to both the use, possession or distribution of marijuana, but rather that by this resolution the Council merely encourages RECORD OF PROCEEDINGS 100 Leaves the amendment of the existent criminal legislation to remove from the use, possession and distribution of small amounts of marijuana the onus of criminal sanction and the attendant consequences, which, activity.
