HomeMy WebLinkAboutresolution.council.007A-72RECORD OF PROCEEDINGS 100 Leaves RESOLUTION NO. 7-,Z~ (Series of 1972) The City Council of the City of Aspen refuses to accept the petition for annexation/annexation election from J.R. Williams Properties for the following reason: The 1. area is not eligible for annexation since: __ There is less than one-sixth boundary contiguity. __ At least two of the following are found to exist: (a) Less than fifty ~0%)percent of the adult residents of the area make use of part or all of the following types of facilities on the annexing municipality: Recreational, civic, social, religious, industrial or commercial; and less than twenty-five (25%) percent of its adult residents are employed in the annexing municipality; (b) One half or more of the land in the area proposed to be annexed is agricultural, and the landowner or landowners of such agricultural land as constitutes at least one-half of the total area proposed to be annexed (including streets), under oath, express an intention to devote the land ~ such agricultural use for a period of not less than five (5) years; (c) It is not physically practicable to extend services to the area. B. ~/ Although the area desiring annexation is eligible for annexation, the City Council finds that it is not in the best i~erest of the municipality to commence annexation proceedings at the present time.
