Series of 1972
WHEREAS, many cities and towns in Colorado
rely upon the power and energy produced by the Colorado
River Storage Project, marketed by the Bureau of Recla-
mation under marketing criteria adopted in 1962, and
WHEREAS, the Arizona Power Authority and others
in Arizona have instituted a suit against the Secretary
of Interior and the Commissioner of Reclamation, being
case No. Civ. 71-683 in the United States District Court
for the District of Arizona at Phoenix, which suit
seeks to set aside the marketing criteria and drastically
curtail the amount of power available to municipally-
owned utilities in Colorado, and
WHEREAS, if the plaintiffs in this suit are
successful, the Bureau of Reclamation will either have
to curtail its deliveries to the cities and towns in
Colorado, or purchase additional power and energy and
pass on to its customers the greatly increased cost, and
WHEREAS, Northern Division Power Association
is planning to seek intervention in the above litigation
in order to protect the interests of the Northern Divi-
sion preference customers of the Bureau of Reclamation,
NOW, THEREFORE, BE IT RESOLVED that the City
of Aspen, Colorado, hereby expresses its support of
the efforts of Northern Division Power Association in

resisting any change to the Storage Project Marketing
Criteria, and authorizes its Mayor, City Manager and
other officials to assist Northern Division Power Asso-
ciation in its endeavors~
