HomeMy WebLinkAboutresolution.council.012-71RECORD OF PROCEEDINGS I00 Leaves RESOLUTION NO. 12 Series of 1971 WHEREAS, the City Council of the City of Aspen has accepted a petition for annexation of that certain territory or real estate particularly described as follows: A parcel of land located in Section 7, Township 10 South, Range 84 West of the 6th Principal Meridian, also being a part of Lots 2, 3, 4 and 5, Block 5 and part of Lots 4, 5 and 6, Block 6, Hughes Addition and a part of Queen Street, pitkin County~ Colorado, being more particularly described as follows: Beginning at a point on the Southerly line of King Street, said point lying South 18°33' East 385.26 feet from corner No. 11, Tract 40, Bast Aspen Addition; thence South 24030' West 142.63 feet; thence South 38°26' West 76.76 feet; thence North 73°29' West 158.70 feet; thence South 13o46' West 34.65 feet; thence North 43°43' West 119.73 feeti thence North 22o54' East 68.03 feet; thence North 63018,30'' East 83.92 feet; thence North 66°21' West 42.12 feet; thence North 34045' East 93.75 feet to the Southerly line of King Street; thence South 66°21' Bgst 255.32 feet along the Southerly line of King Street to the point of beginning~ which was filed with the City Clerk on May 13, 1971; and WHEREAS, the City Council of the City of Aspen makes the following findings of fact regarding said annexation; 1. There is at least one-sixth contiguity between the present City of Aspen and the area seeking annexation. 2. A community of interest exists between the territory to be annexed and the City, as evidenced by the following facts: (a) More than 50% of the adult residents of the area to be annexed use part or all of the recreational, civic, social, religious, industrial or commercial facilities of the City of Aspen, and more than 25% of the adult residents are employed in the City of Aspen. RECORD OF PROCEEDINGS 100 Leaves (b) Less than one-half of the land to be annexed is agricultural. (c) It is physically practical to extend normal urban services to the area to be annexed, on the same terms and conditions as such services are available to residents of the City of Aspen. WHEREAS, said petitioners are the owners of one hundred (100%) percent of the land proposed to be annexed; and, WHEREAS, no election is required under said Act; and, WHEREAS, the City Council determines not to impose additional terms and conditions upon said land proposed to be annexed. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aspen hereby accepts the Petition for Annexation. Is Lorraine Graves, duly appointed City Clerk of the City of Aspen, Colorado, do hereby certify that the fore going is a true and correct copy of the Resolution adopted by the Aspen City Council at a regular meeting held this r-a~.~ day of May, 1971.
