I1 (SERIES OF 1969) WHEREAS, the City Council of the City of Aspen, Colorado desires to pay certain amounts from the General Fund of the City of Aspen, Colorado and finds that there is not sufficient money in said General Fund to effect such payments; and, WHEREAS, the City Council of the City of Aspen, Colorado finds that it is in the best interest of the City to make such payments, and desires to transfer the sum of to the General $45,000.00 from the Water Operating Fund Fund of the City of Aspen. NOW, THEREFORE, BE IT RESOLVED: 1. That the City Clerk and the City Treasurer are hereby authorized and directed to transfer the sum of $~5,000.00 from the W~ter Operating Fund to the General Fund. A copy of this Resolution shall be delivered to the City Clerk and the City Treasurer as the authority to effect such transfer. WITNESS my hand and seal of said City this /~ay of , 1969. City Clerk N? 39 RESOLUTION RESOLVED that Leon A. Wurl, City Administrator, is hereby authorized to employ the law firm of Law, Nagel and Clark of Denver, colorado, to represent the City of Aspen as to all matters, including negotiation and litigation, and concerning the City's desire to oppose the construction, installation and operation of a sewage disposal plant by the Pitkin Iron Corpor- ation and which said disposal plant will be located so as to discharge its effluent into Castle Creek approximately ten miles upstream from the City's water supply intake on said stream. Mr. Wurl is further authorized to contract for and on behalf of the City and with the aforementioned law firm for representation of the City in the matter aforesaid and to pay them for their legal services as follows: Negotiation, trial preparation and pretrial work, including any hearings on any motions at the rate of $35.00 per hour for partners and $20.00 per hour for associates, and in addition, may agree to pay said law firm for trial work at the rate of $150.00 per one-half day provided that no more than two lawyers from said firm are engaged in the trial work at any one time. Mr. Wurl is further authorized to agree to pay said firm its reasonable travel expenses and other incidental legal costs provided the same are agreed to in advance by Mr. Wurl. Mr. Wurl shall request of said law firm that they submit their bills for payment of legal services to the City on a monthly basis and shall make payment accordingly each month. Said agreement for professional services shall continue until the matter is concluded or unless sooner terminated by the City or said firm.
