HomeMy WebLinkAboutresolution.council.002-67RESOLUTION WHEREAS, a petition for annexation of territory to the City~f Aspen was filed with the City Clerk on January.~, 1967, requesting annexation of territory to the City of Aspen, Colorado, which territory is des- cribed in exhibit "A" attached hereto; AND ¥'~EREAS, the petition and the documents attached thereto meet the statutory requirements of the State of Colorado; NOW, THEREFORE, BE IT P~SOLVED that the said petition for annexation shall be and the same is hereby accepted and ordered filed, and that notice over the signature of the City Clerk of the City of Aspen shall promptly be published Monday, March 6, 1967, to law. for hearing to be conducted on at 3:30 o'clock p.m., according ~.~ayor ~ L Lorraine Graves, duly elected City Clerk of the City of Aspen, Colorado, do hereby certify that the foregoing is a true and correct copy of the resolution adopted by the Aspen City Council at a regular meeting held January 24th, 1967. city Clerk PETITION FOR ANNEXATION OF TERRITORY TO TtIE CITY OF ASPEN~ COLORADO Date Petit.ion Filed: We, the undersigned, be/n:., the landowners within the exterior boundaries of the territory hereinafter described, do hereby respectfully petition the City Council of the City of Aspen, C,dorado, to annex said area to the City under the provisions of Chapter 306 of the 1965 Session Laws of Colorado. The following is a legal description of the boundaries of the area proposed to be annexed: Beginning at Aspen Towns:ire Corner No. 1, thence N. We hereby stat(, that we, the signers of this Petition, comprise the landowners of more than fifty (50%) percent of the territory proposed to be annexed, as described above, exclusive of public streets and alleys. We feel that it is desirable and necessary that such territory be annexed to the City of Aspen, Colorado; and we hereby state that not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous w:ith the City of Aspen; and that community of interests exists between the territory proposed to be annexed and the city of Aspen, Colorado; that the territory proposed to be annexed is urban or will be urbanized in the near future; and that the territory proposed to be annexed is integrated or is capable of being integrated with the City of Aspen, Colorado. We hereby allege that, in establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership shall be divided into separate parts or parcels without the written consent of the owner thereof, unless such tracts or parcels are separated by a dedicated street, road, or other public way. We hereby also state that no land held in iden- tical ownership, comprising twenty (20) acres or more, which has an assessed value in excess of $200,000.00 for ad valorum tax purposes, has been included herein without the written consent of the owner thereof. We hereby further state that no annexation proceedings have been commenced for the annexation of part or all of the above described territory to another municipality, and that the above described territory is not presently a part of any incorporated city, city and county, or town.
