WHEREAS, the Planning and Zoning Commission of the City
of Aspen, Colorado, has made certain recommendations to the City
Council of the City of Aspen, Colorado, concerning suggested
amendments to the Zoning Ordinance of the City of Aspen, Colorado,
being title XI of the official code of Aspen; and
W~EREAS, it is necessary that a public meeting be held
concerning such proposed changes, and the City Council deems it
advisable to have a joint public meeting of the City Council and
of the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Aspen, Colorado, that a public hearing on certain
changes in the Zoning Ordinance of the City of Aspen, Colorado,
being Chapter XI of the official code of Aspen, be held in the
District Courtroom in the County Courthouse of Pitkin County,
Colorado, located in the City of Aspen, Colorado, on Wednesday,
July 8, 1964, at the hour of 7:30 o'clock P.M., and that the City
Clerk of the City of Aspen, Colorado, give such notice as is
required by statute and by such zoning ordinance of such meeting.
The City Clerk is further directed to give notice that such meeting
shall concern the proposed following amendments to such zoning
ordinance:
1. That the City of Aspen, by Ordinance, adopt an R-15,
residential district with the following uses permitted and limita-
tions:
Uses permitted:
Any use permitted in the R-6 District, subject to all
requirements specified for such R-6 District, unless
otherwise stated herein.
Minimum Lot Area:
Unsubdivided land - one acre
Subdivided land - 15,000 square feet
Minimum Lot Width:
Unsubdivided land - 150 feet
Subdivided land - 75 feet
Minimum Front Yard Setback:
Principal and Accessory Buildings - 25 feet from front
property line.
Minimum Side and Rear Yard Setback:
Principal and Accessory Buildings - 10 feet from side and
rear property lines.
Maximum Height of Buildings - 25 feet.
2. That the City Council of the City of Aspen, Colorado,
adopt an Ordinance establishing a density control for the T,
tourist district, presently established by the zoning ordinance,
based on the square footage of the land on the building site,
instead of the present requirement of main floor area. The
proposed square footage would be that there be 750 square feet of
land for each living unit, and that the definition of a living
unit would be either a private residence, an apartment, a room in
either a motel or hotel, tourist court, resort cabin, and the like.
3. It is further proposed that the City Council of the
City of Aspen adopt and support a building review ordinance which
would be in the following words and figures:

The
Purpose
The Planning and Zoning Commission shall review all
proposals for new construction located in Business
and Tourist zones in the City of Aspen with the purpose
of conserving the value of neighboring property and
encouraging the most appropriate use of land. The
Commission shall also review all proposed construction
in those areas to determine its effect on the safety,
health, and general welfare of the City of Aspen.
(b)
Method of Procedure - At least thirty days prior to the
date which an application for a building permit will be
accepted by the City of Aspen, the applicant shall submit
a plot plan, floor plans, and elevation drawings of the
proposed construction for preliminary review. These
drawings shall show the complete development of the
proposed project. These drawing~:~ shall~e submitted to
Building Inspector who will submit these drawing~ to
the Planning and Zoning Commission. During this
thirty day period the Planning and Zoning Commission
shall review the drawings submitted and shall make
written recommendations to the Building Inspector as
to the applicant's compliance with the zoning regulations,
and shall suggest any changes in the plans for each
proposed construction as it shall find necessary to
accomplish the purposes of this section. If such
drawings are found to be incomplete, they shall be
rejected.
The above mentioned drawings, with any changes made
prior to the issuance of a building permit and upon
approval by the Planning and Zoning Commission, shall
constitute the final plans and drawings for the com-
plete development of the proposed building site. Any
changes in the approved drawings by the applicant
will require re-submission to the Building Inspector
and the Planning and Zoning Commission.
Upon receipt from the Planning and Zoning Commission
as the approved set of drawings for a proposed project,
the Building Inspector shall register a copy thereof
among its records and shall record a copy thereof, or
such other record thereof, as deemed proper by his
Department, in the office of the Clerk and Recorder.
Ail proposed drawings registered and recorded here-
under shall be binding upon the applicants therefor,
their successors and assigns, shall limit and control
the issuance of building permits and shall restrict

and limit the construction, location, use and
occupancy of all land and structures included
within such drawings to all conditions and limits
set forth in such drawings.
If the Planning and Zoning Commission has taken no
action or has given no recommendations to the
Building Inspector with regard to an application
within thirty days of the time of filing, the
application shall be regarded as approved.
The following items shall comprise the check list
which the Planning and Zoning Commission shall use
in reviewing all new construction in the above
mentioned zones.
(a) Off-street parking
(b) Area of lot in ratio to proposed building
(c) Height of building in relation to the amount
of land used
(d) The amount of open space left in the complete
development
(e) Setbacks
(f) Access to public streets and alleys
(g) Overhangs
(h) The use of the land in the development and its
effect on neighboring property
(i) Traffic and circulation
(j) Density of occupancy
4. It is proposed that the City Council of Aspen,
Colorado, adopt and support an amendment to the zoning ordinance
changing the heighth restriction of the tourist area, and by such
change limit the over-all heighths to structures in the T, Tourist
district, to 25 feet.
5. It is further proposed that the City Council of the
City of Aspen, Colorado, adopt a curb cut ordinance to be included
as a part of the zoning ordinance, and to be in the following words
and figures:
Ail curb cuts shall be of a length approved by the Building
Inspector. Driveways shall be constructed for their 3. fult
width from curb to property line. These curb and driveway
requirements are for access and exit into private property
and for off-street parking.

B- The number and widths of curb cuts for the different zoned
areas shall be as follows:
Residential Areas: Driveway and curb cut widths
shall be twelve feet for a single garage, and fifteen
feet for a double garage at the widest part of said
driveway or curb cut. There shall be only one curb
cut per individual parcel of land. This curb cut
shall be located a minimum distance of ten feet from
either property side line.
Tourist District: In this zoned area each parcel of
land shall either have one twenty foot driveway or curb
cut or two twelve foot wide driveways and curb cuts.
There shall be a maximum number of two curb cuts per
individual parcel of land. The minimum distance
between two curb cuts on an individual parcel of land
shall be twenty feet. The minimum distance between
curb cuts and property side line shall be ten feet.
Business District: The requirements for curb cuts and
driveways in widths shall be the same as those in the
Tourist zone with this exception: 'In the case of a
single lot (30'x100' or 3,000 square feet), a single
curb cut shall be allowed of twelve feet in width,
centered between the property side lines.
Driveway slabs shall have a minimum thickness of six
inches. When driveways are to cross existing side-
walks, the sidewalk slabs shall be removed and drive-
way slabs constructed all of the way back to the
property line.
Unusual Conditions: Under unusual conditions,
topography, drainage, existing trees on City
right-of-way, existing buildings on private property,
or special use requirements for the property, a
variance from these requirements may be given by the
City Council upon filing a written application and a
plot plan showing the building site and the special
conditions thereon.
