HomeMy WebLinkAboutresolution.council.066-05 RESOLUTION NO. 66 (Series of 2005) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN A BALLOT QUESTION AT THE NOVEMBER 1, 2005, MUNICIPAL ELECTION, AND SETTING SUCH BALLOT TITLE. WHEREAS, the City Council is authorized pursuant to Section 5.7 of the Aspen City Charter to, on its own motion, submit questions to a vote of the electorate; and WHEREAS, the City of Aspen expects to assess and collect property taxes during the 2005, 2006, 2007,2008,and 2009 fiscal years which exceed the revenue and spending limits established pursuant to Article X, Section 20(7) of the Colorado Constitution; and WHEREAS, Article X, Section 20(7) of the Colorado Constitution requires municipalities to refund excess revenues not excluded from fiscal year spending unless voters approve the revenue change as an offset; and WHEREAS, the City Council has determined that it desires to allow voters of the City of Aspen to decide whether excess property taxes assessed in fiscal years 2005 through 2009, and collected in fiscal years 2006 through 2010 should be refunded to taxpayers or spent for specified municipal purposes; and WHEREAS, the City Council has adopted the Canary Initiative to coordinate the City's efforts in reducing its greenhouse gas emissions and has determined that it desires to purchase altemative fuel (e.g. hybrid) busses for the RFTA City of Aspen routes to further reduce greenhouse gas emissions from its public transportation system; and WHEREAS the City Council has determined that pedestrian improvements are necessary in the downtown area of the City which might not be funded from existing revenues and some of which are mandated by the Americans With Disabilities Act (ADA); and, WHEREAS, the City Council desires to reduce the pollution and sediments reaching the Roaring Fork River by initiating a stormwater m-off collection and sediment removal project, including immediate improvements to the Jenny Adair Park; and, WHEREAS the original master planning process for the construction of the Aspen Recreation Center (ARC) included a recommendation for the construction of a new outdoor swimming pool, and users of the ARC have identified an outdoor swimming pool as a desirable improvement to the complex; and WHEREAS existing revenue sources of the City may not be sufficient to fired the above referenced projects. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1. The following question, authorizing the City of Aspen to retain excess property taxes assessed in fiscal year 2005 and collected in 2006, and for the subsequent assessment years of 2006, 2007, 2008, and 2009, shall be placed on the ballot at the City's special election to be held on November 1, 2005: CITY OF ASPEN BALLOT QUESTION NO. 1 - AUTHORIZATION TO SPEND EXCESS PROPERTY TAXES. SHALL THE CITY OF ASPEN BE AUTHORIZED TO COLLECT, RETAIN, AND SPEND, WITHOUT INCREASING ANY TAXES OR TAX RATE, PROPERTY TAX REVENUE FROM ASSESSMENT YEARS 2005 THROUGH 2009, iNCLUSIVE, WHICH IS 1N EXCESS OF THE REVENUE AND SPENDiNG LIMITATIONS OF ARTICLE X, SECTION 20, OF THE COLORADO CONSTITUTION AS A VOTER-APPROVED REVENUE CHANGE, TOWARD THE FOLLOWING PUBLIC PURPOSES: · THE PURCHASE OF ALTERNATWE FUEL (E.G. HYBRID) BUS OR BUSSES FOR USE WITHiN THE CITY'S RFTA ROUTES; · IMPROViNG THE QUALITY OF STORMWATER RUN-OFF ENTERING THE ROARING FORK RIVER THROUGH CONSTRUCTION OF THE JENNY ADAIR WETLANDS PROJECT AND ASSOCIATED IMPROVEMENTS TO THE CITY'S STORMWATER RUN-OFF RETENTION AND SEDIMENT REMOVAL SYSTEMS; · DESIGN AND CONSTRUCTION OF A NEW OUTDOOR SWIMMiNG POOL AT THE ASPEN RECREATION CENTER; AND, · CONSTRUCTION OF IMPROVEMENTS TO KEY ELEMENTS OF THE CITY'S SIDEWALK AND TRAIL SYSTEM INCLUDiNG AMERICANS WITH DISABILITIES ACT (ADA) IMPROVEMENTS?
