DEVELOPMENT ORDER ofthe City of Aspen Community Development Department This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070, "Development Orders", and Section 26.308.010, "Vested Property Rights~'. of the City of Aspen Municipal Code. This Order allows development of a site specific development plan pursuant to the provisions of the land use approvals, described herein. The effective date of this Order shall also be the initiation date of a three-year vested property right. The vested property right shall expire on the day after the third anniversary of the effective date of this Order, unless a building permit is approved pursuant to Section 26.304.075, or unless an exemption, extension, reinstatement, or a revocation is issued by City Council pursuant to Section 26.308.010. After Expiration of vested property rights, this Order shall remain in full force and effect, excluding any growth management allotments granted pursuant to Section 26.470. but shall be subject to any amendments to the Land Use Code adopted since the effective date of this Order. City Council granted PLID ADDRESS: 500 W. Hopkins approval to expand the Boomerang Lodge onto the vacant property located south of CURRENT LAND USE: Vacant Parcel the existing Boomerang Lodge across W. Hopkins Avenue pursuant to City Council PROPOSED LAND USE: Ordinance No. 41. Series of 2001. Expansion to existing Boomerang Lodge. Ordinance No. 41 was approved on REVIEW PROCEDURE: October 9, 2001 and the vested rights for Extension of Vested Rights. The Applicant Staff Recommends approval with conditions. wishes to gain approval to extend the vested rights period by five (5) years thereby establishing a new date of expiration of October 26,2009. STAFF COMMENTS: The Boomerang PUD provided approval for the Applicant to construct seventeen (17) additional bedrooms of short-term lodging accommodations and two (2) affordable housing units. That being the case, Staff believes that the previously approved development plan still very much helps to satisfy the community's goals relating to replenishing tlie lodging inventory and providing affordable housing mitigation on-site. The Applicant has recorded a PUD plat and agreement which shows that some progress has been made towards actually developing the project. Staff has not been able to identify any conditions that require performance prior to applying for a building permit that are unsatisfied. However, Staff believes that a five (5) year extension of vested rights is .. excessive. While this development plan does satisfy many current City goals, the vested rights should not be extended so far into the future that potential changes to the City's objectives will yield the Boomerang's approvals incompatible with the community's visions established in the Aspen Area Community Plan. That being said, Staff does not anticipate that the City's objectives related to replenishing the lodging bed base and providing iii-town affordable housing will change significantly over the next three (3) years. Consequently. while Staff believes that this development it is in the best interest of the City and that the request for an extension of vested rights meets the applicable review standards, it recommends that City Council extend the Boomerang's vested rights by only three (3) years instead of the five (5) years requested. STAFF RECOMMENDATION: Staff recommends approval of the extension of vested property rights for three (3) years to establish an expiration date of October 26,2007 for the Boomerang Lodge PUD Development located at 500 W. Hopkins with the following condition: 1. That the establishment herein of a vested property right shall not preclude the applications or regulations which are general in nature and are applicable to all property subject to land use regulation by the City of Aspen including. but not limited to, building, fire, plumbing, electrical and mechanical codes. The developer shall abide by any and all such building. fire, plumbing, electrical and mechanical codes that are in effect at the time of building permit, unless an exemption therefrom is granted in writing. RECOMMENDED MOTION: "I move to approve Resolution No.lo~Series of 2004, approving with a condition a three (3) year extension of vested property rights for the Boomerang Lodge Minor Planned Unit Development located at 500 W. Hopkins as was originally approved by Ordinance No. 41, Series of 2001. The new expiration date will be October 26,2007." EXHIBIT A REVIEW CRITERIA & STAFF FINDINGS SECTION 26.308.010 VESTED PROPERTY RIGHTS Extension or Reinstatement of Vested Riphts In reviewing a request for the extension or reinstatement of a development order and associated vested rights, the City Council shall consider, but not be limited to, the following criteria: a. The applicant's compliance with any conditions requiring performance prior to the date of application for extension or reinstatement; STAFF FINDING: The conditions of approval that were established in approving the original development proposal all are to take effect prior to or in conjunction with the building permit submittal with the exception of the preparation and recordation of the PUD Plat and Agreement. The PUD Plat and Agreement have already been filed with the Clerk and Recorder' s Office. Therefore, Staff does not believe that there are any outstanding conditions of approval that have to be met prior to applying for an extension of vested rights. Staff finds this criterion to be met. b. The progress made in pursuing the project to date including the effort to obtain any other permits, including a building permit, and the expenditures made by the applicant in pursuing the project; STAFF FINDING: Staff believes that the Applicant has intentions of pursuing the project due to the fact that the Applicant has prepared and recorded a PUD Plat and Agreement with the Pitkin County Clerk and Recorder s Office. Staff finds this criterion to be met. c. The nature and extent of any benefits already received by the City as a result of project approval such as impact fees or land dedications; STAFF FINDING: Outside of the application processing costs incurred by the applicant with respect to City Land Use Application Fees and Referral Fees, there have been no benefits already received by the City as a result of project approval such as impact fees or land dedication. Impact fees are collected at the time of building permit issuance. 1-lowever. Staff believes that the approval provides for additional short-term accommodations that would help replenish the Citys lodging base and would serve many of the City s goals if constructed. Staff finds this criterion to be met. d. The needs of the City and the applicant that would be served by approval of the extension or reinstatement request. 3 .. STAFF FINDING: The Aspen Area Community Plan (AACP) specifies that the development of affordable housing within the traditional town site should be encouraged and that the City should strive to replenish the lodging inventory that was lost of the past of decade. Staff feels that the approved development satisfies the above-mentioned goals. Therefore, Staff believes that the proposed extension of vested rights would benefit the City by encouraging the Applicant to pursue the approved development in the future that furthers several of the City's lodging and affordable housing goals. However. Staff finds thO request of five (5) years to be excessive and could potentially yield the Boomerang's approvals incompatible with the community's visions established iii the Aspen Area Community Plan. Therefore, the criteria are met but only for an extension of vested rights for a three (3) year period. 4 .
