HomeMy WebLinkAboutordinance.council.050-98 , ORDINANCE No. 50 (Series of 1998) , , / AN ORDINANCE OF THE ASPEN CITY COUNCIL APPROVING TEXT AMENDMENTS TO SECTIONS 26.36.030(B)(17), RESIDENTIAL NAME AND ADDRESS SIGNS, AND 26.36.040(B), BILLBOARDS AND OTHER OFF-PREMISE SIGNS, OF THE ASPEN MUNICIPAL CODE, PURSUANT TO CHAPTER 26.92, AMENDMENTS TO THE LAND USE REGULATIONS AND OFFICIAL ZONE DISTRICT MAP, OF THE ASPEN MUNICIPAL CODE. WHEREAS, Pursuant to the procedures and provisions set forth in Chapter 26.92 of the Aspen Municipal Code, the Community Development Department has fonnally proposed amending Sections 26.36.030(B)(17) and 26.36.040(B) of the Aspen Municipal Code in an effort to provide a means and parameters for allowing security signs in the City of Aspen; and, WHEREAS, pursuant to Section 26.92.030, Procedure for Amendment, of the Aspen Municipal Code, a development application for amendment to the text of the Municipal Code shall be reviewed and recommended for approval, approval with conditions, or disapproval by the Planning Director a1id then by the Planning and Zoning Commission at a public hearing, and then approved, approved with conditions, or disapproved by the City Council at a public hearing; and, WHEREAS, the Community Development Department prepared a set of proposed amendments and recommended apl'roval to the Planning and Zoning Commission; and, WHEREAS, the Planning and Zoning Commission reviewed the proposed amendments and did conduct a properly noticed public hearing on October 6, 1998, and then continued to November 3, 1998; and, WHEREAS, upon review and consideration of the proposed text amendments, agency and public comment thereon, and those applicable standards as contained in Chapter 26 of the Municipal Code, to wit, Division 92 (Text Amendments), the Planning and Zoning Commission has, by vote of five to one (5-1), recommended that City Council adopt the amendments related to security signs proposed in the Community Development Department staff memorandum dated November 3, 1998, with revisions; and, WHEREAS, the Aspen City Council has reviewed and considered the text amendments proposed by the Community Development Department and the Planning and Zoning Commission, respectively, under the applicable provisions of the Municipal Code as identified herein, has reviewed and considered those recommendations made by the Planning and Zoning Commission, and has taken and considered public comment at a properly noticed public hearing; and, WHEREAS, approval of this ordinance would cause the adoption of the above described amendments to the Sign Code, as recommended by the Planning and Zoning Commission and as further refined by staff; and, Ordinance No. 50 (Series of 1998) Page 1 of3 WHEREAS, the City Council finds that the text amendments contained herein meet or exceed all applicable development standards and are consistent with the goals and elements of the Aspen Area Community Plan; and, WHEREAS, the City Council finds that this Ordinance furthers and is necessary for public health, safety, and welfare. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN,COLO~O: Section 1: That pursuant to Section 26.92.020 (Standards for Review) of the Municipal Code, the City Council finds as follows in regard to the text amendments: 1. The proposed text amendments are not in conflict with the provisions of Chapter 26 of the Municipal Code or the Aspen Area Community Plan. 2. The proposed text amendments will promote the public interest and character of the City of Aspen. Section 2: That Section 26.36.030(B)(17), Residential Name and Address Signs, of the Aspen Municipal Code shall be amended to hereafter read as follows: 17. Residential name and address signs. Every detached residential dwelling unit or duplex unit in the City of Aspen shall have one (1) mailbox or wall sign with an area not to exceed two (2) square feet, and said sign must clearly identify the street address of the dwelling unit and may include the name of the occupant(s). In addition to this square foot limitation, it is also acceptable to include a sign of security nature with an area of up to six inches by six inches (6" x 6"), neutral in color, to be placed upon the wall of the residence, containing a message alerting the general public to the presence of a security system which includes the name and phone number of that security provider and is not primarily an advertising device. If the structure is an Historic Landmark or on the Inventory of Historic Sites and Structures, the security sign shall be freestanding, placed within three (3) feet of and directly in front of the structure without the requirement of Historic Preservation Commission approval. Approved numbers or addresses shall be placed on all new and existing buildings or mailboxes, whichever is more visible from the street or road fronting the property. Numbers shall contrast with their background. Section 3: That Section 26.36.040(B), Billboards and Other Off. Premise Signs, of the Aspen Municipal Code shall be amended to hereafter read as follows: B. Billboards and other off-premise signs. Billboards and other off-premise signs, including security company signs which do not comply with the regulations set forth in Section 26.36.030(B)(l7), are prohibited, except temporary signs as provided for in Section 26.36.120. Section 4: This Ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 5: If any section, subsection, sentence, clause, phrase, or portion ofthis Ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 6: A public hearing on the Ordinance was held on the 25th day of January, 1999 at 5 :00 p.m. in the City Council Chambers, Aspen City Hall, Aspen, Colorado, fifteen (15) days prior to which hearing a public notice of the same was published in a newspaper of general circulation within the City of Aspen.
