RECOMMENDING THAT CITY COUNCIL REPEAL AND RE-ENACT SECTION 24-9
OF TEE MUNICIPAL CODE, HISTORIC DESIGNATION, AND CONSIDER
ADDITIONAL CHANGES TO THE ORDINANCE

WHEREAS,~The Aspen Historic Preservation Committee (herein-
after "HPC") has reviewed the proposed code amendments to Section
24-9 developed by the Aspen Planning and Zoning Commission
(hereinafter "P&Z"), and has had input from various members into
P&Z's review of the proposed amendments, which input was incor-
porated into the version; and
WHEREAS, HPC held a special meeting on March 12, 1987 to
further discuss Section 24-9 and arrived at several more recom-
mendations for changes to the document; and
W~ENEAS, HPC supports the proposed code amendments.
NOW, THEREFORE, BE IT RESOLVED by the Historic Preservation
Committee that it does hereby recommend that the City Council
repeal and re-enact Section 24-9 of the Municipal Code to read as
the version attached to P&Z's Resolution No. 87- 2 with the
following changes (new language in bold):
Section 24-9.2(d)(1) (vi) (on Page 2) add: "Recommenda-
tion to the Planning and Zoning Commission to initiate
amendments to this article."

Section 24-9.2(d) (3) (i) (on Page 3) insert: "Nomina-
tions for membership shall be presented to the City
Council by the Aspen Historical Society and the
community-at-large, and through personal application."
Section 24-9.2(d) (3) (i) (on Page 3) insert: "When a
regular member resigns, the alternate member with the
most seniority on HPC shall automatically be appointed
as a regular member in replacement."
Section 24-9.2(d) (3) (viii) (on Page 4) add: "Any
member of the HPC who has three (3) or more unexcused
absences or more than four consecutive excused absences
from regular meetings may be subject to removal by the
City Council."
Section 24-9.2(d) (6) (ii) (on Page 5) delete: "If a
matter is postponed to more than two (2) regular
meetings after the meeting for which it was scheduled,
due to lack of quorum, then the application shall be
deemed approved."
Section 24-9.2(d) (3) (vii) (on Page 4) change: "The
secretary shall...mail notices of special meetings to
be received two (2) days in advance..."
Sections 24-9.2(e)(4) (on Page 5) insert: "To provide
planning and technical assistance including recom-
mendation to the HPC, the Planning and Zoning Commis-
sion and the City Council in regard to this article and
to provide information at a regular meeting of the EPC
regarding historic preservation items being heard by
other City boards in advance of those hearings."
Section 24-9.3(f) (on Page 9) add: "An application for
rescinding designation shall follow the same submission
requirements and review procedures as for designation
described in subparagraph (b) above except that with
respect to subparagraph (b)(i)(c¢), an explanation
shall be included describing why the designated
structure is not consistent with the standards in
Section 24-9.3(a)(1)-(6)."
BE IT ALSO RESOLVED that the HPC is concerned with the
matter of sufficient public hearing notification for demolition
and removal review and intends to make a recommendation on the
matter prior to second reading of Ordinance 10 (Series of 1987).
