DRVZ$ SZLV! ! of 2 R 10.00 D 0.80 N 0.00 PZTKZN COUNTY CO RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION APPROVING AN APPLICATION FOR MINOR DEVELOPMENT LOCATED AT 400 W. SMUGGLER STREET, ASPEN, COLORADO RESOLUTION NO. ~ 7, SERIES OF 1999 WHEREAS, the applicants, Larry and Sara Dodge, represented by Insight Construction, have requested minor development approval for the property located at 400 W. Smuggler Street, Fractional Lots R and S, Block 33, City and Townsite of Aspen and Fractional Lots 18 and 19, Block 33, Hallam's Addition to the City and Townsite of Aspen. The property is a designated historic landmark; and WHEREAS, all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.72.010(D) of the Aspen Land Use Code in order for HPC.to grant approval, namely: Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof; and WHEREAS, Amy Guthrie, in her staff report dated July 14, 1999, 'performed an analysis of the application based on the standards, found favorably for the application, and recommend4d approval with conditions; and WHEREAS, at their regular .meeting on July 14, 1999, the Historic Preservation Commission considered the application, found the application did not meet the standards, and continued the hearing to July 28~h, at which time they approved the revised application with conditions by a vote of 7-0. Smuggler Street, Fractional Lots R and S, Block 33, City and Townsite of Aspen and Fractional Lots 18 and 19, Block 33, Hallam's Addition to the City and Townsite of Aspen be approved with the following conditions: 1. The design shall be shed dormers as presented at the July 28"' meeting. 2. Retain all existing materials on the exterior of the historic buildings, other than those herein approved for restoration or replacement. 3. No other exterior changes, beyond what is approved herein, may be undertaken without further review. APPROVED BY THE COMMISSION at its regular meeting on the 28th day of July, 1999.
