APPROVING VARIANCES RELATED TO A STORAGE SHED FOR THE PROPERTY
LOCATED AT 1295 RIVERSIDE DRIVE, LOT 20, RIVERSIDE SUBDIVISION, CITY
AND TOWNSITE OF ASPEN, COLORADO
RESOLUTION NO. 9, SERIES OF 2004

WHF, REAS, the applicants, Tony and Kathy Welgos, represented by Consortium Architects and
Gilbert Sanchez, have requested variances for a storage shed on the propen~y located at 1295
Riverside Drive, Lot 20, Riverside Subdivision, City and Townsite of Aspen; and
WHEREAS, for approval of setback variances, the HPC must review the application, a staff
analysis report and the evidence presented at a hearing to determine, per Section 26.415.110.C of
the Municipal Code, that the setback variance:
a. Is similar to the pattern, features and character of the historic property or district; and/or
b. Enhances or mitigates an adverse impact to the historic significance or architectural character
of the historic property, an adjoining designated historic property or historic district; and
WlclEREAS, Amy Guthrie, in her staff report dated March 24, 2004, performed an analysis of
the application based on the review standards and the "City of Aspen Historic Preservation
Design Guidelines, and recommended approval; and
WHEREAS, at their regular meeting on March 24, 2004, the Historic Preservation Commission
considered the application, found the application was consistent with the review standards and
"City of Aspen Historic Preservation Design Guidelines" and approved the application by a vote
of 5 to 0.
NOW, THEREFORE, BE IT RESOLVED:
That HPC approves a 6'6"east sideyard setback variance, a 3'6" rear yard variance, and a 6'
· reduction of the minimum distance between buildings for the remodeled shed as represented on
March 24, 2004.
APPROVED BY THE COMMISSION at its regular meeting on the 24th day of March,
2004.

Dear Tony and Kathy;
On March 24, 2004, the Aspen Historic Preservation Commission approved on-site
relocation for your non-historic shed at 1295 Riverside Drive. The approval was
formalized through the adoption of HPC'Resolution #9, Series of 2004, and stated that
the board was approving the plan as it was represented at the public hearing.
One aspect of the plan that was brought before HPC was a proposal to lower the height of
the shed by reconstructing the roof pitch. At your request, I have recently re-visited this
issue with Valerie Alexander, the project monitor assigned to your house, and we are no
longer requiring the roof change given the structure's limited visibility by the public.
I understand that you wish to have this amendment recorded, which will be handled by
the Aspen City Clerk's office.
