HomeMy WebLinkAboutordinance.council.004-72RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1972) AN ORDINANCE AMENDING CHAPTER 24 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN BY ADDING SUBSECTION (d), SECTION 10.1 OF CHAPTER 24 ENTITLED C-PND COMMERCIAL PLANNED NEIGHBORHOOD DEVELOPMENT DISTRICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN , COLORADO: Section 1. Section 10.1 of Chapter 24 of the Municipal Code of the City of Aspen is hereby amended by adding Subsection (d) as follows: "Sec. 24-10.1. PUD planned unit development. C-PND commercial planned neighborhood develop- ment district: Intention - to allow convenience establish- ments as part of the neighborhood, designed and planned to be comparable with the surround- ing neighborhoods, and meant to reduce traffic generation, circulation and parking problems and the public costs of correcting said circulation and parking problems. Areas permitted application for this C-PND Commercial Planned Neighborhood Development District shall be permitted only in areas not subdivided at the time of adoption of this Ordinance. Uses - permitted (1) Only uses which are approved by the Planning Commission and the City Council will be permitted. Uses which are approved shall be designated on the Final Development Plan. (2) Only the following uses shall be considered for approval: (a) Small convenience establishments, den signed and intended to serve the daily or frequent trade or service needs of immediately surrounding population. Such establishments include food stores, drug stores (pharmaceuticalS, liquor RECORD OF PROCEEDINGS 100 Leaves stores, dry cleaning and laundry pick up stations, barber shops, beauty shops post offices, service stations and other retail establishments similar to the above; (b) Residences for those employed in said small convenience establishments may be included in principle buildings; (e) For the purpose of this zone district service stations sb~ll not include body repair, major mechanical repairs and engine rebuilding; and rental or sale of vehicles and trailers. (d) Specifically excluded are eating and entertainment establishments with the exception of snack and coffee bars. Lot and Yard Requirements - as set by the Planned Unit Development Plan. Maximum Building Height - as set by the Planned Unit Development Plan. Development Standards (1) The C-PND district shall be located on a public street with a minimum right-of-way of 100 feet and a classification of major street as defined in the City of Aspen subdivision regulations. (2) The combined square footage of commercial buildings shall not exceed 12,000 square feet and shall consist of a minimum of three (3) separate and distinct uses not including gas- oline service stations and post offices. In no case shall the square footage of a drug store exceed 3,000 square feet. Square footage of gasoline service stations and post offices may be in addition to the 12,000 square foot maximum. (3) A minimum of twenty-five (25%) percent of the gross site area shall be landscaped. (a) A landscaping plan shall be submitted by the applicant as part of the Final Develop- ment Plan and shall require Planning Commission approval. (b) The landscaping plan shall indicate the types of plantings, their suitability, -2- RECORD OF PROCEEDINGS 100 Leaves arrangement and location and shall include the screening and buffering of adjacent property. (c) The Planning Commission shall ensure that adequate provisions had been made for the care and maintenance of the landscaped area by the owner(s). (4) Buildings shall be constructed to be compatible with the character of the adjacent neighborhood. Trash shall be stored indoors or concealed from view by solid fence. Where indoor trash storage is provided, the floor area devoted to such storage shall not be included in the allowable floor area. Minimum Off-Street Parking Requirements - as set by the Planned Unit Development Plan. The Planning Commission may use as a guide Section 24-9 (f) entitled Off Street Parking. Signs - as provided for in Section 24-7(a) C-1 Commercial and in the Supplementary Regulations. Procedure for approval - subject to Section 24-10.1(b)o Procedure for change of zoning under this Section shall comply with Section 24-10.1(b). Procedure for amendment under this Section - as provided in Section 24-10.1(b)." Section 2. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such in- validity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or application, and to this end the provisions of this ordinance are declared to be severable.
