WHEREAS, all of the owners of lots in Block 82, Aspen,
have heretofore petitioned the City Council to vacate the alley
in said Block 82,
WHEREAS, the Petitioners desire to utilize said alley
for parking purposes and to provide certain landscaping in
connection with existing improvements in said block,
WHEREAS, the City Council for the City of Aspen did not
desire to vacate said alley for the reason that it was believed
by the Council that the public rights should not be vacated at
this t±me, but that there would be no detriment to such public r~ghts
by way of utilizing said alley for parking pruposes and permitting
landscaping to be done in accordance with plans heretofore submitted
to the Council, and that by reason thereof, said alley ought to
be closed to public traffic,
NOW, THEREFORE, be it RESOLVED'
1. That the Owners of Lots in Block 82 shall be and
are hereby permitted to utilize the alley in Block 82 for purposes
of parking and landscaping in accordance with plans submitted to
the City Council and on file with the Clerk;
2. That said alley shall be and is hereby closed to
public travel until further order of the City Council, providing
however, such alley shall be available to emergency vehicles as
may be necessary to protect the public health, safety and welfare~
3. That by reason of this closure of said alley for the
purposes horein provided, the City shall not and does not assume
any l~ability in connection with injuries to persons or property
which may occur upon any of said alley used for the purposes herein
provided by the adjoining land owners; the City does hereby reserve
the right and provilege to demand indemnity against any ¢la~ns as
may be asserted against the City by reason of personal injury or
property damage occurring on said alley and may demand from adjacent
land owners insurance to be with a company authorized to do businesses.

4. In the event any person ~ball construct improvements
on said alley in the nature of landscaping or parking facilities,
he shall not be entitled to any dammge therefor by reason of
action of Council rescinding this Resolution, excepting as may be
provided by separate agreement.
