HomeMy WebLinkAboutresolution.apz.015-96 ' RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION RECOMMENDING APPROVAL WITH CONDITIONS OF THE CONCEPTUAL PUD SUBMITTAL FOR THE ASPEN MOUNTAIN PUD FOR LOT 5 (GRAND ASPEN SITE), AND RECOMMENDING DENIAL OF THE CONCEPTUAL PUD SUBMITTAL FOR THE ASPEN MOUNTAIN PUD FOR LOT 3 (TOP OF MILL SITE) Resolution No. 96- I~ WHEREAS, Savanah Limited Parmership has submitted an application for conceptual Planned Unit Development ("PUD") approval for Lots 3 and 5 of the Aspen Mountain PUD, and subdivision approval for Lot 3 of the Aspen Mountain PUD; and WHEREAS, The Aspen Planning and Zoning Commission (hereinafter referred to as "Commission") did consider the application for Conceptual PUD and subdivision request at public hearings held on March 19, 1996, July 2, 1996, August 6, 1996 and September 3, 1996 for the subdivision request, and public meetings on April 9, 1996, May 14, 1996, and August 20, 1996 to consider the Conceptual PUD request; and WHEREAS, On October 3, 1988, the Aspen City Council did allocate development allotments for lots 3 and 5 of the Aspen Mountain PUD, as memorialized by the First Amended and Restated Planned Unit Development / Subdivision Agreement-Aspen Mountain Subdivision, recorded in Book 574 Page 792. The Commission has proceeded in a good-faith effort to review the project within the context of these prior agreements. NOW THEREFORE, BE IT RESOLVED by the Planning and Zoning Commission of the City of Aspen, Colorado: Section 1 That it does hereby recommend that the Aspen City Council grant conceptual PUD approval, with conditions, for Lot 5 (Grand Aspen Site) pursuant to section 26.84.030 of the Aspen Municipal Code, based on compliance with the following criteria: o The proposed development is consistent with the Aspen Area Comprehensive Plan; 2. The proposed development is consistent with the character of existing land uses in the surrounding area. 3. The proposed development does not adversely affect the future development of the surrounding area; 4. Final approval is only granted to the development to the extent to which GMQS allotments that have been obtained by the applicant; Section 2 That the recommendation of approval by the Commission for Conceptual PUD and subdivsion for Lot 5 (Grand Aspen Site) is conditional on compliance with the following: 1. All representations of the applicant, either contained in the application or stated in meetings before the Planning and Zoning Commission are considered conditions of approval. 2. At the time of final PUD submittal, the applicant shall present a detailed plan for the proposed pedestrian mall linking the Ritz and the Little Nell. These plans shall include detailed landscaping plans, pavement treatment, proposed lighting and any proposed street fia'nimre. 3. At the time of final PUD submittal, the applicant shall submit plans, in cooperation with the Community Development Department, proposing enhancements of the Ice Rink to increase the public use of the existing space. Proposals may include physical modifications or amendments to the range of uses currently allowed on the site. 4. At the time of final PUD submittal, the applicant shall provide a detailed landscape plan indicating the treatment of all exterior spaces in the proposed development. The landscape plan shall include the following: ae The extent and location of all plant materials and other landscape features; Flower and shrub bed definitions; Proposed plant material at mature sizes in appropriate relation to scale; Species and size of existing plant material; Proposed treatment of all ground surfaces (e.g. paving, turf and gravel); Location of water outlets; and A plant schedule with common botanical names, sizes, quantities, and method of transplant. 5. At the time of final PUD submittal, the applicant shall submit a proposed lighting plan, including location and design features to ensure that the fixtures are consistent with existing lighting features. 6. At the time of final PUD submittal, the applicant shall submit a statement outlining a development schedule specifying the date construction is proposed to be initiated and completed, any proposed public facilities the developer is proposing to construct, and the phasing and construction of the public facilities. The plan shall ensure that impacts to adjacent property owners and public fights-of-way are minimized to the maximum extent practical. 7. The applicant shall comply with its representations summarized in a memo from the Engineering Depaament dated June 26, 1996 and incorporated into the public record. Section 3 That the Commission recommends denial of the proposed conceptual PUD for Lot 3 (Top of Mill), based on non-compliance with the following standards of review, Pursuant to Section 26.84.030 of the Aspen Municipal Code: le The proposed development shall be consistent with the Aspen Area Comprehensive Plan; 2. The proposed development shall be consistent with the character of the existing land uses in the surrounding area.
