HomeMy WebLinkAboutresolution.apz.031-96RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION FOR THE APPROVAL OF THE WINNERMAN STREAM MARGIN REVIEW LOCATED AT 315-317 PARK AVENUE Resolution No. 96-~! WHEREAS, pursuant to Section 26.68.040 of the Aspen Municipal Code, the Planning and Zoning Commission may grant approval for development within 100 feet, measured horizontally, from the high water line of the Roaring Fork River and its tributary streams, if the development is determined to be in conformance with the requirements of said Section; and WHEREAS, the Community Development Department received an application from Larry Winnerman for Stream Margin Review approval to repair and stabilize the fiver bank which was damaged by the flooding of the Roaring Fork River in 1995; and WHEREAS, the City Engineer, Parks Department and Community Development Department reviewed the proposal and recommended approval with conditions; and WHEREAS, the Commission reviewed and approved the Stream Margin Review with conditions by a 7-0 vote on September 17, 1996; and NOW, THEREFORE, BE IT RESOLVED by the Commission that it does hereby approve the Winnerman Stream Margin Review with conditions as follows' o Prior to issuance of a building permit, the applicant shall provide to the City Engineer three wet ink original blueline prints of the restoration design signed and stamped by a current Colorado registered professional engineer. , Prior to the commencement of work, fencing delineating the boundaries of the work area shall be installed. Fencing shall be maintained until completion of the project. o A landscape plan shall be reviewed and approved by the Parks Department prior to building permit approval. Only native riparian vegetation is allowed. . All material representations made by the applicant in the application and during public meetings with the Planning and Zoning Commission shall be adhered.to and considered conditions of approval, unless amended by other conditions. o The applicant shall inform the Community Development Department as to the date work will commence, and staff shall monitor the initial stages of work.
