HomeMy WebLinkAboutresolution.apz.033-97RESOLUTION OF THE ASPEN PLANNING AND ZONING COMMISSION DENYING THE COMMERCIAL RESTAURANT USE OF REQUIRED OPEN SPACE FOR A COFFEE CART ON THE NORTH SIDE OF THE GUIDO'S BUILDING, 425 EAST COOPER AVENUE, CITY OF ASPEN PARCEL NO. 2737-182-21-009 Resolution #97- WHEREAS, the Community Development Department received an application from Guido's Swiss Inn Limited Partnership, represented by David and Leslie 'Jordan Estes, for the' commercial restaurant use of required open space for a coffee cart on the North side of the Guido's Building, 425 East Cooper Avenue, City of Aspen; and, WHEREAS, pursuant to section 26.04.100 of the Municipal Code of the City of Aspen, required open space may be used for commercial restaurant use if the Planning and Zoning Commission determines the use is compatible with or enhances the purposes of the open space requirements and adequate pedestrian and emergency access will be maintained; and, WHEREAS, the application was referred to the relevant agencies and the Housing Office, Fire Marshall, Environmental. Health Department, City Engineering Department, and Community Development Department reviewed the proposal and ?~,c0~q~ended approval with conditions; and,' .!. ,~ ~. :~,., · WHEREAS, the Community Developm~f'~)e~ai't~nt did, p~._~"P~iblic notice at the proposed location t° inform interested parties of~t~e~p~ica, tioi~ ar~[~o~ai~0~the Planning and .... · ~,.~.~.~ ,~. ~,~ ~,.~ , ..,~ .:~'~ ~, . · .~ Zomng Commission the option to take and coh~i~ter?ibllc comment~, attar, ~.: '...,~ :: :t WHEREAS, the Planning and Zoning:COmmi~ic;n did opt'~tO i:a~ke and consider public comments during the meeting; and, WHEREAS, during a regular meeting on December 16, 1997, the Planning and Zoning Commission denied, by a 5-2 vote, the application finding the proposed use would be incompatible with the purposes of the open space requirements. NOW, THEREFORE BE IT RESOLVED by the Aspen Planning and Zoning Commission that the commercial restaurant use of required open space at 425 Cooper Avenue is denied. DENIED by the Commission at its regular meeting on December 16, 1997.
