APPROVAL FOR THE JOHNSTON RESIDENCE HALLAM LAKE ENVIRONMENTALLY
SENSITIVE AREA REVIEW AND CONDITIONAL USE FOR AN ATTACHED ACCESSORY
DWELLIN~ UNIT AT LOT 2 OF THE MERRIAM LOT SPLIT SUBDIVISION
Resolution No.
WHEREAS, Lot 2 of the Merriam Lot Split Subdivision is within
the review area for the Hallam Lake Bluff Environmentally Sensitive
Area (ESA); and
WHEREAS, the Planning Office received an application for a
Hallam Lake ESA review and Conditional Use review for a single
family residence with an attached accessory dwelling unit at Lot
2 of the Merriam Lot Split from Jeff Johnston, represented by
Michael Doyle; and
WHEREAS, the 498 net livable square foot below-grade
accessory dwelling unit is being provided in accordance with the
housing mitigation requirements set forth in Section 24-7-
1003.A.2.b. of the Aspen Municipal Code which requires that any
development on a lot created by a lot split must contain an
accessory dwelling unit; and
WHEREAS, the Parks Department, Aspen Center for Environmental
Studies, and the Planning Office reviewed the proposal and
recommended approval with conditions; and
WHEREAS, at a public hearing at a regular meeting on May 5,
1992 the Planning and Zoning Commission approved by a 6-0 vote the
Hallam Lake Bluff ESA review and the Conditional Use review for an
attached accessory dwelling unit, amending the conditions
recommended by the Planning Office.
NOW, THEREFORE BE IT RESOLVED by the Commission-
That the Johnston Hallam Lake Bluff ESA and Conditional Use for a
498 s.f. net livable, below-grade accessory dwelling unit is
approved with the following conditions-
1. Prior to issuance of any building permit, the applicant must
receive approval from the Parks department regarding any vegetation
removal from the site.
2. Prior to issuance of any building permit, a revised landscaping
plan must be submitted to Planning Which provides adequate access
from the ADU to the driveway.
3. The owner shall submit appropriate deed restrictions to the
Aspen/Pitkin County Housing Authority for approval. The units
shall be deed restricted to resident occupancy with minimum 6 month
leases. Upon approval by the Housing Authority, the Owner shall
record the deed restrictions with the Pitkin County Clerk and
Recorder's Office.
4. Prior to issuance of any building permits for the property, a
copy of the recorded deed restrictions for the accessory dwelling
units must be forwarded to the Planning Office.
5. One parking space shall be dedicated on-site for the accessory
dwelling unit.
6. Prior to issuance of any building permit, a covered entryway and
stair area must be included to protect the ADU access from rain and
snow shedding.
7. The building permit plans must clearly indicate the accessory
dwelling as a separate dwelling. Compliance With U.B.C. sound
attenuation codes is required.
8. Ail material representations made by the applicant in the
application and during public meetings with the Planning and Zoning
Commission shall be adhered to and considered conditions of
approval, unless otherwise amended by other conditions.
