CONDITIONAL USE APPROVAL OF AN ATTACHED ACCESSORY DWELLING UNIT
LOCATED AT 530 WEST FRANCIS STREET, ASPEN COLORADO Resolution No. 93- ~

WHEREAS, the Planning and Zoning Commission held a public
meeting December 8, 1992; and
WHEREAS, pursuant to Section 5-508 an accessory dwelling unit
is a conditional use review requiring a public hearing; and
WHEREAS, the Planning staff recommended approval of the
·
accessory dwelling unit with conditions; and
WHEREAS, the Commission reviewed the conditional use and
revised the conditions of approval to add a 'seventh condition of
approval'
7. The roof shall be designed so the snow will not shed into
the primary and secondary access into the accessory dwelling
unit.
NOW, THEREFORE BE IT RESOLVED by the Commission that it does
hereby approve the conditional use for a 310 square foot detached
accessory dwelling unit located at 530 West Francis Street with the
following conditions prior to the issuance of any building permits'
1. the applicant shall, upon approval of the deed restriction by
the Housing Authority, record the deed restriction with the Pitkin
County Clerk, Recorders Office and Planning Department. The deed
restriction shall state that the accessory unit meets the housing
guidelines for such units, meets the definition of Resident
Occupied Unit, and if rented, shall be rented for periods of six
months or longer.
2. all representations that are made in the application and those
reviewed and approved by the Planning and Zoning Commission shall
be complied with.

the applicant shall submit a revised site plan to the
engineering department, depicting the following'
drainage plan
o North Fifth Street, West Francis Street, the alley and
any proposed work in the public right-of-way.
4. the applicant shall work with the Parks Department for pruning
of the trees.
5. the applicant will enter into a curb and gutter installation
agreement with the City of Aspen.
6. the adu shall conform with UBC sound attenuation requirements.
7. the roof shall be redesigned so the snow will not shed into
either the primary or secondary access of the accessory dwelling
units.
APPROVED by the Commission at its regular meeting on December
8, 1992.
